Hello,


I Came in UK 22-01-2004 on student visa. At the min my Tier 1 Entrepreneur visa application is under process. I can apply ILR 28 days before completing 10 years from 26-12-2013 . My question is :-

If my Tier 1 Entrepreneur visa application refuse after 26-12-2013 can i still eligible to apply ILR on the basis of 10 years with or without appealing against that refusal?

I am not asking about Varying application. I am asking about

sorry Amber still not understand it. I don't know much abt uk law so still confused.

for example on 02-01-2014 my tier 1 entrepreneur visa application refuse. can i still vary my tier 1 application to ILR after refusal?

On 26/12/13 send in a completed form SET(LR) and ask them to vary your PBS application, with reference number, and pay any additional fee (the difference between PBS and LR, if any).

Actually I applied Tier 1 Entrepreneur with my team member so if i vary my application to ILR his application gonna be Invalid that's why i m asking if i wait till the tier 1 decision come and if HO refuse our application for any reason so can i still eligible to apply ILR coz i already completing my 10 years qualifying period ?

As Amber is saying, that way there wouldnt be a situation where your tier application will be refused

You can make an out-of-time application within 28 days of an in-time application decision. However, if you didn't have leave when you applied, you'd have to make sure the application was perfect, as there would be no appeal rights.
