What after Tier 2 General + Renewal if ILR not possible?

Hello all,

From my understanding Tier 2 General is granted for maximum of 3 years + renewed once for another 3 years.
What happens if someone cannot meet the criteria for ILR after that and sponsor / employer still needs them?

Is it possible for an employer to apply for a new Tier 2 General visa for the employee and bring them back to the UK by following the same process?

This would give them another change as they can re-enter in less than 28 days (with proper planning it should be possible?) and they can apply for ILR under 10 years long residency or 5 year route again then.

this is only true if the initial T2G was granted under the rules on or after 6 April 2011, otherwise there is no limit to the number of extensions

cooling-off would apply (unless a high earner).

I would be one of those coming back to UK under the new rules (post 6 Apr 2012) so I guess I am permitted a maximum of 6 years only (1 renewal).

So ultimately I will need to make sure I meet the criteria for ILR during the time here or look for other prospects outside UK after that duration.
