Work Permit 5 years - No dependants
Application sent :19/Sep/2013
Received by HO: 20/Sep/2013
Acknowledgement letter received: 23/09/2013
Biometric enrolment letter received : 11/Oct/2013
Biometric enrolled :12/Oct/2013
Still waiting - 4 and a half months now. Have not contacted HO yet, will wait until 6 month "anniversary" before try to call. Hopefully it doesn't come to that though.

If you are interested there is an Freedom of Information request for ILR's submitted for a week in September 2013.

Hi Suzan, I would recommend contacting your MP if you have not done so already. http://findyourmp.parliament.uk/
From what I have read and heard ILR's of our variety are taking about 8 months to process on average. I really hope your's arrives soon.

Hello,
I have just got a refusal letter today from HO!! They refused me under the COP rules. i am an old work permit holder.
I have got work permit on 18th of june 2008 as a hotel manager and the salary was £19k (45 hours pw).
But under the COP on my position it says, I have to earn £19k (39 hours pw)!!
as i believe HO made this rules on March 2011.
On my last p60 (which i did submit on HO) was £19,700
My question is, why they applying the new rules on me and what should I do now?
I have a right to apeal by 18th of February.
I need all of your advice please. Any referance will be much appreciated.

Suzan I am sorry to hear your application is refused and after 8 months of waiting, I don't have enough knowledge to advise in your case but my feeling is that new rules apply as you made your application after they came in force and i don't think the fact they don't exist at the time of your grant of extension will exempt you from the new rules, I hope that you still have the option of extension under work permit if your appeal is declined, i also recommend a good lawyer advise before your appeal.

@Suzan999 - really sorry to hear about the refusal. As Norts recommends, legal advise is probably your best option now. Please keep us updated as to your progress. Hope you get it sorted.

@Psalm - nope, not yet. On the cusp of the fifth month since delivery and to be honest, not holding my breath - yet, still got 3 months of waiting I reckon.
I see you're on a similar time as me...I've gone through the emotions too, it's sickening. Some days I say to my wife about a zillion times, "it's going to get refused"...reminds me of something my sister once said to my Dad when he pointed out a Zulu warrior to us as kids, "Look! There's a warrior!", and my sister, looking up at him, puzzled frown, asking him "what does he worry about?". Hang in there mate and let us know if you get anything through.

hello sachin,

i have submitted an application on 27th Jan 14, via same day PEO appointment at croydon. I was told that application is valid but they need to do further enquiries.

Applied as main applicant + 3 dependants being on Tier 1 General for past 5 years although did arrive in the UK on student visa in September 2003.

I have applied as company director with all the relevant docs. They did not ask for any more docs and hasn't been any communication whatsoever.

It has been more than 12 working days and don't know when this anxious wait is going to finish.

Please share if someone has gone through with the same kind of scenario.

4. 1 year Bank statements corroborating salary

9. Co-habitation proof of 3 years (Joint Bank statement + Council Tax bills)

Urgent Help Required,
I would be Grateful for advice please, I received an email from My Case worker asking for letter from my employers to confirm that my absences from UK (total of 91 days, scattered over 5 years) are covered by Paid annual leave, Here is the the email:
"I am the case worker dealing with your application for settlement in UK. Unfortunately you have omitted to include a letter from your employer confirming that your absences from the UK during the 5 yr qualifying period were covered by paid annual leave. The Immigration Rules are prescriptive in this regard and I have to have it before I can approve your application. I am happy to accept it by email from your employer so please feel free to forward this email to them"
I am very confused as my understanding you only need evidence if your collective leave is >180 days, My application is SET (o) after 5 years of Tier 1 General Migrant, again does it matter in my case as "Tier 1" and not work Permit holder to prove that my leaves are under paid annual leaves??

Firstly I think it does not matter at all of u r in route to ilr via tier 1 but did u apply as company director salary/ dividend or as a full time employment.

Also was your application postal it did u go to PEO?

And when did you apply?

Secondly I think if that is the only thing holding your application back then just get this letter somehow and send it to him instead of wasting your time arguing about the fact whether it was valid for him to ask this doc in your application although not required.

I believe an email from your previous managers will be sufficient. They can make it quite simple and specific on dates. They should also note that it was paid vacation. You will be fine. Wish you the best.

May be you can just a forward this email to all the concerned hospitals where you worked and ask them to respond and then send that email back as a proof. I think that would be sufficient and thanks for sharing this with us all.

I traveled abroad for one week while i was in between employments (i.e unemployed) will that cause any troubles?, can someone explain to me why it is important to provide evidence for very short leaves and to prove they are covered by paid leaves!
i think i still keep my electronic ticket for that trip, and it was a holiday.

i doubt if they will give you issues because of the 1 week holiday when you were unemployed. I think the point they are trying to establish is that you are majorly residing in the UK and you have not taken up employment outside of the uk during this period. To what i think, the worst that can happen is to regard these days as absent but in overall is negligible so it can be disregarded.

My best advise for you is to try and get as many evidence as possible to support all you paid holiday. i believe once the case worker receives the absent details, they will grant your ILR. Maybe you should write a supporting letter(email) to explain the 1 week holiday- Seniors please advice on this. if you were self employed during this period, you can regard that as paid holiday and write a letter to back it up starting you were self employed and its your holiday.
