Hi

I have finally received my ILR today on 10 year basis. I am now planning to apply FLR M for my wife and little kid who was born in India.I have not yet received UKNARIC document for english language test.

I have following questions:

1) We have to provide 2 years documents. How do you spread it evenly? I am just thinking to provide one document for each six month but bank statement just cover 1 month. Also, I have two bank accounts which are joint. Can I use them to cover 2 years period and one of them for maintenance??? My wife came down in 2010 in UK so I will be exempted from salary earning requirement.

2) what other documents do you provide? I am thinking to put 2 joint bank statement, 1 joint utility bill (Ebill Gas & electric - hope thats fine),my wife's provisional license - my full driving license. We have asked for GP's letter but they seems to be confuse. I have requested them to write that we are register with medical practice with our full name and address. I hope that is sufficient.

3) My wife she was away to India for Nov 2011 - Sep 12 because of pregnancy. she was having complications so she had to stay back home in India. Do we need to provide communications as a proof we were in touch? We have a letter from doctors back home stating that she was having complications.

Please advise ASAP

I called home office today and asked the same question, the home office rep said that you can't do that because of BRP. But she said you can do that a day apart. For example if you apply FLR(M) on Monday, you can apply for SET(M) on Tuesday. I did not ask about BRP that if you'll get a BRP next day before you apply SET(M) or what.
To double check the above information its always advisable to get second opinion or third or fourth
I think its better for you to call home office and ask them as well as here in the forum.
Home office number is 0870 606 7766, try using landline as it will be cheaper. It took me 14 minutes. Thanks

I sent my SET (LR) and wife FLR (M) together. I got my ILR Today and my wife FLR (M) is still pending with the HO. Do i have to write to HO attached with my ILR approval and BRP to process the flr (M) application or just wait??

my situation is similar to yours but I have applied for ILR on 30th Sep, got approval letter on 10th Feb.
applied for my wife's FLR (M) on 5th Dec and Bio done on 21st Dec and waiting for the decision.

On 11th Feb I have sent a letter to HO requesting to process he application as initially I have requested to withhold FLR-m until a decision is made on my ILR (not sure whether this will make a different)- but no harm in giving them a kick in the backside with a letter and copies of your ILR docs

on another note: I dont seems to find any processing timelines for FLR M applications on this forum, OR may be I am missing something?

Thanks Alexander12, i got my Approval yesterday and BRP today. As you said i also requested them to hold my FLR(M) until decision is made on my ILR. Thats good no harm in requesting them to start processing the flr (m) application. So i will definitely write them today.

I received a positive response, very much unexpectedly, on 19 February from the Home Office. Here is my timeline:

FLRM application posted: 13 January 2014
FLRM application received: 14 January 2014
Confirmation of receipt received: 22 January 2014
Request for more information received: 6 February 2014
Invitation for biometrics received: 6 February 2014
Biometrics registered at Post Office: 7 February 2014
Additional information sent: 11 February 2014
Additional information received by HO: 12 February 2014
Biometric residence card received: 19 February 2014
Passport and documents received: 19 February 2014 (under separate cover)

This four week process was much faster than expected. I submitted my application 2 days before the expiration of my Tier 4 student visa. I submitted my FLRM in full knowledge that my wife and I did not meet the financial threshold requirements of category B, the category we were forced to apply under because my wife had worked at her current employer for only 4 and a half months at the time of the application. As my student visa was expiring and as I didn't want to leave the country because I care for my young son while I await my paperwork, I wanted to submit an application in country. Also, I knew decisions were being paused which would give us time until that 6-month period had been reached.

My original application was submitted with a detailed covering letter that explained our situation: 1) that I was a full-time student in the 12 months prior to the application and did not have time to work 2) my wife decided not to work last year because we have a son who is under the age of 2 (I should state that he is not subject to any immigration control as he holds a British passport). I explicitly stated in the covering letter that I intended to vary the application (if necessary) to category A once my wife hit her 6 months of continuous employment at her current employer. She was to hit that threshold in early March of this year.

In early February, I received a request for more information which included my wife's payslip for January and some additional proof that we have been living together. A short week after I sent that information to the HO, I received both my passport and resident card in the same day.

It appears that the HO used some discretion on their part to decide my application because we did not meet the financial threshold requirement of category B, having earned only 14,000 in the 12 months prior to the application, and were not eligible to apply for category A as my wife only began work in September 2013. They must have found the evidence I provided sufficient to grant the application with a few weeks before my wife's 6 continuous month at her employer.

I used this board a lot in the months before submitting my application and was prepared for a very long and frustrating timeline. I do honestly think that the detailed covering letter must have helped the case workers reviewing my application, and I would suggest that if there are any extenuating circumstances in one's case that one should consider writing them up. The FLRM application form didn't seem to capture my story, and I felt that it needed an accompanying story to humanize it.

I have 3 different source of joint name to cover 2 years and planning to put up some individual document to support our 2 years living together.

I received ILR on 10 years long residency base on 24th April,2013. and send my wife and my daughter application for extension using FLRM .on 29th April2013. As my wife came to UK in April,2009 a first time and since that time she was living here so she was in the pre July,2012 rules. No financial requirement and for maintenance requirement at the time of initial application. My wife visa was refused based on that I did not fulfill the financial requirement of £22000 and the HO couldn't verify my wife English language certificate online.
We launched an appeal. and they accepted that the HO has considered my wife case wrong and I do not have to fulfil the financial requirement. but they asked me what I am doing now and I said working as a structural engineer with gross pay 32000£ but then they checked bank statement and found the loan and credit cards and said we have to do the calculations again to check if i satisfy the maintenance requirement after deducting the loan instalments. The judge told us to send a Doctor letter explaing the medical condition of our second son who is three months and still in the hospital after having two major heart surgeries. I send the Doctors letter along with other documents and the covering letter attached.
In the decision the court accepted that I satisfy the maintenance requirement after deducting rent, council tax , loan instalment and credit card bills but still they decided not to give my wife the visa based on her initial application which was a 2 years route to settlement because they were doing the future predictions that in April 2014 I will be paying tax and my pay will not be enough to fulfil the maintenance requirement as I am not paying tax because I started my job in Nov,2013.

Is it worth to appeal against the decision or let it be like this in which case my wife will have to wait 10 years for settlement.

man............this seems like a story from some kind of film.......I am really sorry and feeling sympathetic with your situation bro....I think you should get yourself a good solicitor and sort this out with them....I am sure you would have had a solicitor for your appeal, but there is also a higher tribunal and the high court i suppose where you can still go....

Hi Kunal,

I submitted pretty standard documents proving my co-habitation. They included utility bills, council tax bills, HMRC correspondence, tenancy agreements, and bank statements. Most of the documents were submitted in either my or my spouse's name as we did not have any correspondence that was addressed to us jointly. I made sure to supply at the very least 4 pieces of evidence for every year of my residency, and I made sure that those letters were spaced out over the year.

keep trying with option 2 or 3 as soon as you get connected, you don't have to listen to everything what computer says, you'll eventually get through. Apart from that its normal to get biometric letter in a month time. so i don't see any problem there unless its taking way too long...

You never know with Home Office. They said after 01.01.14 they will deal with applications within 8 weeks from the date when the application was sent, and if they can't make decision in this period they will inform applicant. So you might not need to worry before this period lapse.

My family member applied for his wife in Jan 2014 and the home office didn't accept the English test of Toiec and send a letter with atteted passport copy to book English test from another listed body. In March he submitted English test result from another body and start waiting for Biomatrics letter, After a week he call at 01142073463 and they given a public inquiry number when he tried that number he got same response as you had. Anyway he call back again on above mention number than they sort out his wife's biomatrics letter and dispatched with recorded delivery. Thank you for your support and insightful information. I called the number mentioned just a while ago and was advised that they deal with English Language Requirement issues only. I was suggested to contact the regular UKVI 0870.. number. So I presume these guys were able to help your friend's case as there was issue with English Language Requirement.

Hello everyone.

I am about to apply for FLRm form. Both my wife and I are working and salaries are over 50K. everything seems within hand.

My only concern is that i am considered as an overstayer now as I got refused before due to salaries being lower than 18k. now situation is completely different.... however i dont have rights to work.

What are the chances of them finding if i decide to continue with work while applying and awaiting their decision? do they check?

Please help if you know something as the stress is growing daily.
