Made an application

Post by ukilrforman » Tue Apr 09, 2013 10:30 am

Eligibility criteria: 2yrs HSMP + 3 yrs Tier 1 General + 1yr ILR
Method of application: Via Immigration Solicitors on 04 March 2013
Date of receipt by UKBA: 05 March 2013
Date of debit of fees: 12 March 2013
Date of receipt of Acknowledgement: 18 March 2013

Date of receipt of Approval: Refused received on 11 April 2013.....

I received the news that the application has been refused. The grounds on refusal are: to be in the UK on the day, exactly 5 years prior from the date of application. This is quite confusing.

On the 4th and 5th of March 2008, I was in the UK. we sent the application by special delivery out on 4th march 2013. it was received on 5th of March 2013. however the UKBA counts +1 day for its internal purposes. hence they count the day 06 th March 2013 less five years making it 06 March 2008.

Now I flew out of the UK on 05th march 2008, and although it still counts to be in the UK, however, not on the 06 march 2008. On these grounds, they have refused the application.

I am free to apply on the first available eligible date.
no return of fees though.

this is my last post until my next application advised by my solicitors (to be advised later).

regards

i'm asking before I've read one thread in this forum that when u send application for citizenship via ncs,u get 1 letter with the approval and an invitation for the ceremony,so just asking if this is what happened with your case and if there is people who had similar case, can they tell us about their experiences pls..
I applied through NCS for self, wife and my son. I got 3 separate letters in 3 envelopes on the same day. They all directed me to call Council office and book an appointment within 21 days for the ceremony. For child, I was given a choice, i.e. ceremony is optional.

As far as I'm aware, you have to book the ceremony date yourself once the approval letter has been received.
thanks.

Brown envelope is a myth; the registration certificate I received for my two kids was in a white envelope.

Do a search with the folowing "Eligibility criteria: EEA" and you will find several.
Basically, the eligibility criteria doesn't affect the timescales of the application.
Thanks Jambo, I couldn't find anything in GOOGLE!! did you mean in this forum? still can't find it!!
And finally do you mean, whatever background we apply for BC on, the time scale for BC is the same for all applications?
I have many friends, they apply for BC and they wait months and even over 1 year but based on ILR on asylum route.
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.
PR dated 05/03/2013

Yep.. Many lucky applicants had their applications processed in under 3 weeks. I was one of the not so lucky ones and waited 4 months, chicona as you can see waited almost 6 months and some people on this forum have been waiting for over a year.

Why some applications take longer/chosen for extra checks/put on ice, nobody really knows. You just apply and keep your fingers corssed. Good luck!!
I disapprove of what you say, but I will defend to the death your right to say it...

Eligibility criteria: 6yrs Discretionary Leave + 1yr ILR
Method of application: Postal: Special Delivery

Date of receipt by UKBA: 08/03/2013
Date of debit of fees: 13/03/2013

Date of Ceremony: 25/04/2013

It was a very quick and straightforward process. Took exactly 4weeks from postal of application to approval.
My advice to anyone would be not to use the NCS unless they really need their passport back. Postal application seems quiicker and it is obviously a cheaper method. The application is straightforward and there is no real need for NCS if you read the guide and follow.

Anyway this website was very useful and i am very grateful for it. Thanks to all contributors.
