EEA4 fast processing times or wishful thinking

Just to let u guys know my little strange story

-My wife got PR after succesful EEA3 application
-I applied for EEA4 on 02 February 2012
-Made complaint several times since the begining of October by e-mail, fax and post but never got any reply from them.
-Been calling them few times a day they keep saying"your application is not being completed, we do not have further information and we can't requst for COA letter, u must wait"
-Requested Passport back first time on 05 October 2012 and again requested several times Via Email, application form, post, calling them but they never replyed and returned our doduments!
-Contacted Mp
-Opened case with Solvit
-Opened case with European Commition
-Opened case with European Ombudsman
-Opened case with European Parliament and made a petition

Still no COA letter
what ealse on earth am I suppose to do?

Hi Everyone,

I'm new to this forum despite having checked it on a number of times whilst I was preparing to send my documents to the Home Office.

I'm a non EU citizen married for over 5 years to an EU national ( A 8countries). Got a family member residence stamp for a year when I first applied in June 2007 then a 5 years residence card which was due to expire in July 2013. In 2009 my wife and I had a baby and she stopped working after her maternity leave came to an end. The complication was that even though she was looking for work, mainly applying for jobs on line, she eventually stayed unemployed for almost one year and 10 months, so from October 2009 until March 2010 she was a job seeker, then from March 2010 until February 2011 she was just looking after our baby as we had some childcare issues, from March 2011 until March 2012 we had a Comprehensive health insurance, but in the mean time September 2011 until now she started working again. Bottom line she was at least 11 months doing nothing other than looking after our baby, I have always worked through out this 5 years period but it was irrelevant as she was the one supposed to exercise her EU treat rights. Since I could apply for a Permanent Residence Card this August, then I did back in August.

Time line:

06/08/2012 Application sent by recorded delivery, received by the home office on the following day.
01/09/2012 The home sent everything back, saying that there was not enough evidence qualifying us for Permanent residence
01/09/2012 same day I wrote a letter explaining how my wife had exercised her treat rights under the EU regulations and asked them to check carefully the contents of the application as all the documents relevant to our case were there, including a letter explaining that she had stayed 11 months just looking after our baby for a number of reasons and to please not send the application back without further consideration.

17/10/2012 I got a coa

10/12/2012 We got our documents back, mine and my wife's all together, PR and Permanent Residence Card both issued on the 01/12/2012.

Happy days!!!!

I think that a good letter explaining how she exercised the treat rights and how they could find the evidence among the documents sent was key to get these applications granted in my opinion fairly quick, compared to a number of posts I read in this forum, specially around long absences and comprehensive health insurance.

We have finally received the PR card and an Immigration Status Document (the A4 page) for my non-EU spouse - dated 03/12/2012, received 20/12/2012

Hi All,

I'm new to the forum - just wanted to give our EEA3/EEA4 timeline and see if there is anyone else in a similar situation.

EEA3/EEA4 submitted on 5 July 2012
COA received 10 October 2012 (more than 3 months!!!!)
Passport returned on request for the non-EEA spouse on 3 November 2012
No response yet on PR and we are getting very anxious as Christmas holidays are approaching and we would both like to travel .....

The COA states that they try to solve all cases within 6 months - is this 6 months from initial application or from COA being issued? It's confusing in the letter.

Pleasant surprise waiting for me when I got home. A special delivery envelope...

Opened it up and both EEA3 and EEA4 given! woot!


EEA3/4 sent to UKBA 30/08/12
EEA3/4 received UKBA 31/08/12
Letter from UKBA stating received documents on 28/10/12
EEA3/4 Fully received on 21/12/12

Took them 2 months to acknowledge actually receiving my documents, but from then on only 2 months for both EEA3 and EEA4

I haven't been on this forum for a while now, I hope you are all good and enjoying the holiday.
You might already know about my situation(at front of judge at appeal day HO secretary withdraw their decision which was a refusal and asked me to resend my documents for the period before marriage).
I had resent the documents since 11/10/2012 and I rung and HO said they have received them. Now it has been over two months and I haven't received to response and when I ring them they say they only see documents received and nothing else, I have to write to HO secretary which I already have but again NO response.
Any idea guys how long they need to make decision, should I ask for documents back so they will speed the process or will it affect the decision?

Spiky boy I am sorry to say that there is not such an idea except repeatedlly calling them and bombard them with letters+faxes.
Let is put it this way a "barbaric monster or dragon try to kill or eat ur kids and wife! ur first reaction would be throwing whatever u have at him"
Do ur best do not give up they are barbaric psychopaths they are bully individuals, I can see the end of this bully regime!

or Mp+Solvit+etc... u know all this any way

EEA4 received, timeline for reference below:

EEA4 sent 11/08/2012
CoA received 10/10/2012
PR received 27/12/2012

for the past 3-4 weeks we have been trying to get back the passport because of urgent need to travel on business even though previous residence permit had expired. Contacted local MP and requested urgent consideration and also contacted UKBA to request passport back with the new form via email (this has changed from the previous process of requesting via phone). Not sure which of the two helped or whether it was just our turn in the queue for consideration and the above actions were a coincidence.

Good luck to everyone waiting. UKBA seem to have been changing their processes over the past couple of months so hopefully not too long wait for people still in the queue!

I dont get it!!!!! why when some one ask question you dont even comment but when u see a comment regarding UKBA misconduct u quickly change the subject by posting unrelated comments!

U think u can hide reality by hiding few comments

I understand your frustration as you've been waiting since Feb, but this forum thread is not just about your case but about general processing times for EEA4 applications, which is why I've posted my timeline for other people to compare to theirs. I've personally found this useful and this is why the thread name is "EEA4 Processing times".

I've read your original post about the case but after all you've done to get this expedited I don't understand why there is no progress after 10 months. The only thing I can think of is request your passport back via the new form online, if you give them a call on the phone they'll direct you to it. They have recently gone through a reorganisation of how they provide support and I have to say the call wait has dropped from ~30 min to less than 5min recently and the passport return process length is now max 10 days.

Ziko....simply report in police station and fill the new form and attach all required documents along with the covering letter in which explain that you lost your RC some where and reported in police station.

Yesh but ravii I dont have all those document like proof of addres or marriage certificate and Id! can I just fill the application and send it with a covering letter?
