Hi Inkedhaf, in regard to the documents it will be your passport, biometric card, life in Uk test, English test and some evidence for you existence in the UK like previous p45, bank statements etc

Did I not state she can change to FLR(M) at any time, provided she does not have travel plans out of the UK (risks having her visa cancelled if she travels).

so her visa wont get curtailed once my status will change... thats what you mean...right? but in case of travelling she need to apply.

Read the form and guidance notes, it tells you very clearly what limited documents are required if you have all your passports.

Hi, Please quick advice needed. I am planning to apply SET (LR) on base of 10 years long residence. In came is country in April 2008 and subequently extended my visa:
# August 2008 - Dec 2011 - student visa
# Dec 2011 - Dec 2013 - PSW
# Dec 2013 - Dec 2016 - Tire1 (Ent)
# Dec 2016 applied for extension
# 26 March 2018 Refused the extension
# 11 April 2018 applied for Admin Review
# 13 June 2018 Admin Review refused
# 26 June 2018 - FLR (FP) Application
# 17 Aug 2018 Biomatric given.
My question is am I eligible to apply for SET(LR)? (Some said i can, some said i can't. i am confused.) PLEASE help me. or what is the best possible route to stay in the UK legally? Your advice will be highly appreciated.

Hello all,

I am due for my 10-year settlement for the end of August 2019. But I need to go away for from 20 December 2018 - 3 March 2019 (74 days). This is for work.

Question: One can be away for 180 days in the year leading to August 2019. Is that right?

Question 2: Is the max total number of away days 540 for the 10 year-period?

It's just hard and confusing to read the documents as I am dyslexic. I also don't know which is the latest.

1. Yes. Although note that it is 180 days at any time in the 10 years, not only the last year.

My solicitors advises me that my 10 year starts from the date of visa issue if I have entered UK within 90 days . My date of UK entry will be used when I traveled to UK after more than 90 days of visa issue.




I have secured appointment on 21st. I have calculated on the basis of 10 years from visa issue date . I traveled to UK after 25 days of visa issue.

I am confused about the calculation. Please see both arguments below.
Please advise if I should cancel?

Your solicitor is wrong. It is based and starts from the date you entered the UK. The visa validity date is ONLY relevant when a migrant already in the UK regulates their stay, ie getting Discretionary leave to remain while IN the UK.

The enter within 90 days is ONLY relevant to ILR based on 5 years residence through points based route visas.

First of all I do apologies if my post is not in an appropriate thread. If this is the case, I would be very thankful if the moderators could kindly move it to the correct location for me :)

I'm preparing my ILR Settlement application on the basis of Long residence - SET (LR). I am going for my PSC appointment next week so just want to double-check if I have all the necessary documentations:

Completed SET (LR) application form - version 13/7/18
2 photographs - meeting UK passport requirements
2 passports - old and current, these are all the passports I've held during my 10 years residency.
Current Biometrics Residence Permit.
Life in the UK Test Pass
Degrees taught at UK Universities
PSC Appointment Booking confirmation and payment confirmation

My total absences from the UK comes to 406 days in 10 years with no break more than 180 days at a single time.

I have no criminal convictions, and have never entered/tried to stay in the UK illegally

Immigration History:
First entered the UK 8/9/2008 on Student visa - valid until Oct 2010
September 2010 - Oct 2014: PBS Tier 4 General
July 2014 - August 2015: PBS Tier 2 General
July 2015 - August 2017: PBS Tier 2 General Extension
July 2017 - July 2020 (my current leave to remain): PBS Tier 2 General Extension.

I'd be very grateful if someone could cast their eyes through and let me know if these documentations are sufficient? Only because these documents seems quite limited compared to all the previous applications which I did for my previous leaves/visas.

Can anyone please tell me if my admin review is refused, will I still be eligible to apply for SET (LR) after my 10 years stay? I did my FLR(FP) application within 14 days of my admin review refusal which is now pending.

Had my SET(LR) application approved at the PSC today and can confirm that that's all the documentation you need. It seemed very limited to me too! In case you didn't realise, you're OK to apply right now as, like me, you're within 28 days of your 10 year anniversary.

By the way, if you can spare the cash, I'd highly recommend going through the PSC.

My FLR(FP) application is pending (applied on 22june2018, biometric done 17aug1018). My 10year residence was completed on 23 August 2018. I have got an appointment for my SET(LR) application on 6oct2018. How likely it is that HO will take the the decision of my FLR(FP) before 6pct2018?

No one can answer that question. Given that you applied for flr PR after AR refusal, your section 3C ended when AR was refused. Also unlikely you will get a same day decision for ILR.

You really should start your own topic with your complex circumstances as not many people read this long running topic. Posts such as yours get lost in this thread.

Hello CR001,

May I ask what kind of situation would make HO defer your case under LR route? I have had one in-time application refusal (with appeal right) in 2014 and I submitted a fresh application ten days after I received the refusal letter and the visa was granted. Do you think this would cause my case to be deferred during my appointment please? Thank you very much.

Thanks for your immediate reply. Referring section 3C of the Immigration Act 1971, my solisitor said as I applied for FLR(FP) within 14 days of the AR Refusal, My section 3c is not ended; therefore I can apply for SET(LR). I am confused now. Please advice me what to do?

AR refusal ends your section 3C protection if you previous visa already expired regardless of how quickly you submitted another application. For the overstay to be disregarded, the FLR FP app would need to be successful.

Could someone help me with the below queries please:

1. I complete 10 years LR on the 24th September 2018, so am i eligible to apply for ILR (LR) from the 26th August 2018?

2. What does the following statement mean: '' Premium appointment have to be within the 28 days of you completing your qualifying period ''. So in my case does it have to be between 26th August 2018 and 24th September 2018 ?

3. I have been completing the online application form to apply for ILR though LR. I am married but my partner isnt in the UK yet and has no intention to come to the UK anytime soon. At the end of the application there is a tab which says documents and under that they have included marriage certificate and partners passport to be produced. Does anyone why this is being asked when I have stated that my partner isnt in the UK? I rang the immigration helpline but he wasnt too sure either he said for the appt just take documents that are applicable to me.

4. Is SET (0) same as SET (LR) ? I am asking this because under the premium appointment booking system they have an option for other but no option for LR, so i selected the other option hoping that is correct ?

You can apply anytime WITHIN 28 days before reaching 10 years long residence, calculated from the date you ENTERED the UK.

You cannot apply any SOONER than within 28 days of reaching the residence requirements.

No, it is NOT the same form or route to ILR. You don't state what options you are given. We don't all have access to the online system!
