Hi Raja Brit,
I have applied for my EU3 in May 2020 as my permit was expiring Nov 2020. I have emailed the EU treaty so many time and was replied that my application is still in progress.
I received an email last week and the response was that my application is currently processing and a decision will be issued in due course.
My questions: do I need to registered the withdrawal card agreement for spouse of Uk citizens or do I wait for the EU Treaty contact me ?

Many thank in advance for any reply
Jean

Hi,

You need to wait for the decision of your EU Application.

WAB exchange scheme is only for those who have Stamp 4EUFAM already granted who are dependent on UK Citizens before December 31st, 2020. Hence the need to exchange the card to a WAB Card.

In your case, your permission expired November last year and I believe your must have a temporary extension for Stamp 4EUFAM which should cover adequately while awaiting a decision.

I hope it clarifies .

Anytime. By the way, I posted the following under a different thread. So your permission should be auto-extended till April 20th, 2021.

Have you applied for Citizenship too if I may ask?

Also may I know when did you get your temporary extension till Feb 2021?

Great, I can see people are getting temporary Stamp4 extension on the same month they apply for EU3.

This at this point, it will make sense to apply for Citizenship after you get your PR which should be anytime.

Im applying for EU3 for my dependent tomorrow via email. My only concern is if they grant temporary Stamp 4 extension, I don't have my UK Passport yet (coz its with Citizenship Team) which GNIB will need to stamp my dependent's non-EU passport.

I don't suppose there is an expiry date for Stamp 4 extension letter is there where you need to get the extension from GNIB within a certain timeframe?

Hey Raja Brit,
Yes people is getting the temporary extension quickly.

I didn’t go to Burgh Quay to get my passport stamped because of the current situation.

No there is no a timeframe date on the letter.

I am seeing alot of people saying they are going to apply for EU3 after doing the card exchange programme.

Can someone point to me where it says you can apply. Its my understanding that the reason the card exchange programme was introduced is because you cant rely on EU Treaty Rights anymore.

Why are you applying for permanent residence under EU Treaty Rights if you arent subject to EU Treaty Rights anymore...

Non-eu dependents of UK Citizen can apply for EU3 Permanent Residence card whose WAB or Stamp4 EUFAM card is expiring in 6months of 5years residency based on "Free
Movement of Persons Regulations 2015 and the entitlements guaranteed under the Citizens Rights element of the Withdrawal Agreement".

Please ready the following FAQ which will answer your 2nd question. Bear in mind, all this information is in the INIS Website.

Q 6. I am currently the holder of a Stamp 4 EUFam Residence Card which is due to expire in late 2021. Will I be able to apply to apply for a permanent residence card next year?

Yes. You will be eligible to apply for a permanent residence card using Form EU3. Your application will be considered in accordance with the Free
Movement of Persons Regulations 2015 and the entitlements guaranteed under the Citizens Rights element of the Withdrawal Agreement.

If your application is successful, you will receive a Stamp 4 Residence permission in the State instead of a Stamp 4 EUFam permission as the free
movement element will no longer apply after 31 December 2020.

Applied & sent off forms on January 18th.

Reply 3rd February that it got accepted.

Need to wait 5-10 working days for the card - not a bad turn around considering the circumstances of time right now.

Have you not received "application has been completed" email? Acknowledgement is the very first email everyone gets.

If the email you got is a completion email, then you should have received the following in the same email:

"....

The processing of your application has been completed and you will shortly receive your new Irish Residency Permit Card by post - (approximately 5-10 working days)..

If you have not received your IRP Card after this time, please email burghquayregoffice@justice.ie and write “No Card Received” in the subject bar."

Hope it helps.

If you are implying exchange of cards from Stamp 4 EUFAM to Withdrawal Agreement Beneficiary Card, then yes, seperate application for each applicants.

As per the recent update, it takes 25 to 30 working days to process the card.

Have you first of all received the acknowledgement email?

If you have received the acknowledgement, I suggest you email as per the following notes from Registration Office.

'If you have not received your IRP Card after this time, please email burghquayregoffice@justice.ie and write “No Card Received” in the subject bar." '
