ILR success at Solihull on 26-11-2013

Hellos,

I have finally decided to apply for my ILR and will apply for wife’s ILR when she completes 2 years on tier 1 dependant visa so Apr 2014.
Booked appointment in Solihull end of this month.

I have few minor queries hoping to get some answers.

1. I have a degree (Bachelor of Engineering ) taught in English. I can see the course and university in Points based calculator.
So I do not have to give the language test. Is that correct?

2. All of my absences are holidays and they are well within 180 days over last five years. Do I still have to produce letters from my employers about my absences?

Not necessarily, but if you can then well good.

3. I am contracting currently and I get my salary through the umbrella company. Payslips are just one page document in black and white (looks like printed off the excel or something).

Most of my pay slips (in the past) through Umbrella Company were look-a-like Excel sheets. However, I did requested for a separate letter confirming that these payslips were genuine and any further details can be requested.

But payslips has umbrella company name, address and all sort of details but no signs or stamps. Is that ok or I need to get it signed and stamped from the umbrella company?

Again, if you can then not a bad idea.

4. I get it from this post that there is absolutely no impact on wife's Tier 1 dependant visa even though main applicant will be granted ILR. (I mean she can travel in out of UK and also work in UK as she is currently). Hope that’s correct…

1. That’s a relief. Thank you.
2. I will attach copies of e tickets with the application. On few occasions I was in between the jobs when I was out of UK so difficult to get letters from employers.
3. I have managed to get a letter from company confirming authenticity and stamps on the salary slips

I am claiming for the points from 1 November 2012 till 31st October 2013.
Salary payments are made bi-weekly with the processing delay of 1.5 weeks.
So salary slip shows period from 14th Oct 2013 to 27th Oct 2013 however payment for this is made to my account on 5th November 2013. And my continues 12 months period is 1 November 2012 till 31st October 2013.
Is this situation acceptable? Please suggest. thanks in advance.

Hi All,

My ILR application was successful at Solihull on 26-11-2013 under the tier 1 general category

After the security check I was asked to wait for my ticket number to be called for. Then asked to proceed to the counter.
Caseworker asked how am I satisfying my English language criteria. He asked because it’s a new rule and lot of people are tripping off as they is not aware of the new rule. (I had given original degree certificate and PBS assessment to show that it appears on it)
After biometric I was asked to come back after 2 hours. Application was ready for the collection and I was explained that I will receive new BRP card in 7 to 10 working days.

Documents:
Cover letter (including the earnings and absences table)
Set(o) application
Two photos
Life in UK pass letter
Original degree certificate
PBS assessment sheet
12 month payslips
12 months bank statements showing salary transactions
Letters from current umbrella company confirming employment, authenticity of pay slips and earnings breakdown
5 Year P60s
e-tickets to support absences as I didn’t have anything else (all absences were pure holidays 115 days in last 5 years)

@Vinny, Thank you very much its getting clear. Had she made an application pre-July she would've benefited from the transitional provision. Any other route to cut short this 5 yrs of limbo.

Do you mean your wife got into the UK after July 2012???
If she got into the UK before that, and you have been staying together ever since, THEN she is eligible for ILR as show would satisfy 2yr probationary period.
The period need to be as dependant
also it needs not be continous.

Congratulations mate. Do you have to do anything for your wife's visa and can she travel in and out of UK on Tier 1 Dependant visa though you are on ILR now ?

Whilst submitting application, i asked case worker same question.
Provided my application is successful, i will move to ILR and my wife will still be on Tier 1 dependent when i am no longer on Tier 1 visa. He said there will be no issues with her visa and she can apply independently when she qualifies for the ILR. hope that helps.

@rbk1597. She needs to complete 2 years on Tier 1 dependent visa. I also thought earlier she will be eligible after 2 years regardless of the which visa as long as we live together.
I think they have changed the rule. I think i saw one post in this forum with similar situation and dependent visa was rejected.

Congrats on your Approval. Need an advice please! Have a query regrading the PBS calculation form. How did you calculate/submit it when you do not have a ILR option? And do you still get points for English Language and maintainance of Funds for ILR as well?
