Hi Forza!

Well in our letter to our local MP we pointed out that we know that the HO cleary stipulates in our Certificate of Application letter that our EEA2 application could take upto six months ie July 11 (for our application), but our main concern is that our application has not even been assigned to a case-worker yet and it has been in their possession for two months now. We also mentioned in the letter that we have been in touch with other EEA2 applicants on this particular forum and read other immigration forums on the internet on this topic and have noted that the HO in a lot of occasions has been unable to process the EEA2 applications within this six month time period so we need the MP to assist us in chasing up our application to make sure that we will not become victims of this unnecessary delay that others have experienced.

So we hope our local MP will see our points and try to help us somehow.

Thats our news so far so we'll keep you posted.

I called Liverpool yesterday (12/03) and they told me that a decision was made on Thursday (11/03) and that my passport etc is waiting to be despatched by special delivery. So that's good news. I don't know yet what their decision is, but at least they have made one within 6 months.

Wet - Did the HO requested any extra/additional documents after the 14th of September?

I am planning to send some additional documents to the HO such as contract of employemnt (I signed it after the application), January & February payslips etc...

Forza - the HO wrote to me on 30 November requesting further evidence that my sponsor and I are living together. I have heard nothing from them since.

Why is the HO find it very hard to issue RC to an extended family members (brothers, sisters and cousins of an EEA member)?
Time to discuss about this now

5.4 Extended family members

All cases involving extended family members should be referred to a senior caseworker prior to a decision to either grant or refuse being despatched.

Regulation 8 of the 2006 Regulations covers extended family members (e.g. brothers, sisters, aunts and cousins) and direct family members (e.g. parents, children over the age of 21) who have failed to provide evidence of financial dependency.
•
Cases involving extended family members should normally be refused where the EEA national is a student. However, if the non-EEA extended family member has been issued an EEA Family Permit, possibly on the basis that the EEA national was exercising Treaty rights in another capacity at the time that the Family Permit was issued, then refusal may not be appropriate. 5
For example, an uncle of a self-sufficient EEA national may be issued with a Family Permit if he had demonstrated to the entry clearance officer that he was a dependent relative. The EEA national becomes a student after his uncle’s arrival, but before the uncle applies for a Residence Card. In theory a Residence Card should be issued, but not before it has been establishes whether the EEA national can support his uncle.
Conditions for qualifying for a right of residence as an extended family member
An applicant for a residence card may be considered on the basis that s/he is an extended family member under Regulation 8 (2) if he/she satisfies the following conditions:
•
s/he was residing in the same EEA state as the EEA national, where she was dependant on the EEA national or a member of the EEA national’s household, before the EEA national came to the UK; and
•
s/he has joined the EEA national in the UK and continues to be dependant on him or a member of his household.
Note: there is no dependency test for persons who can show that they have lived under the same roof as the EEA sponsor before coming to the United Kingdom and live under the same roof in the UK.
The Directives refer to facilitating or favouring the admission of any member of the family who meets any of the above conditions. Providing that a person falls within one of these categories, you may issue a Residence Card if in all the circumstances it appears appropriate to do so.
When deciding whether it is appropriate to issue a Residence Card, caseworkers will need to assess whether refusing the family member would deter the EEA national from exercising his/her Treaty rights or would create an effective obstacle to exercise of Treaty rights. Each case must be assessed on an individual basis but an example of where it might be appropriate to issue a Residence Card would be if the family member were very elderly or incapacitated. In assessing such cases, it would be important to consider whether there were any relatives to care for them in their home country.

If you provide the require documents, they will find find something else to refuse the applicant for RC. The UK goverment is just refusing extended family member without reasons.

I applied on 6th Jan 2010, but I haven't heard diddly squat from them. I even emailed a request for an update last week, but they haven't bothered even replying.

there is sign of a case work team on my COA with case id , so i think they allocated to a case work team,

we applied eea1 & eea2 together on 22/01/2010... though my wife supposed to get eea1 by this time.

if anybody knows how long it may takes to get EEA1 for a self-employed people.

There is a number on the COA but it is just a reference number. It is not a case reference number. The number on the COAs just confirm that they have received the application, that is it...

The reference number on your COA is your unigue case id for your application and there is another number which is your home office number.
