For a PR card application, there is no need for the period to be 5 years immediately preceding the application.

The PR card is simply a confirmation of an already existing state known as PR.

So if somebody is meets the requirements to qualify for PR from 2004 for 5 years, and then was out of the UK for 14 months, and since then has been back, the period considered would be the 5 years from 2004 to 2009.

If you do a non-obvious period, then it is very important to explicitly tell UKBA over which period you got your PR. Best to write a cover letter that says "This application is in respect to 5 years of continuous residence from 2004 to 2009"
I agree. I did not say the 5 years need to be immediately before. Just that the period needs to be continuous and prior (as my example shows).

please advice what documents should be submitted to HO for BC.
It is logical but logic doesn't always work well with big organisations. Also, you are making a claim. Make sense for them to ask for originals evidence again to examine your claim.
Better to make the application simple for them to process if your aim is to save time.

The list of documents needed for BC application is listed on the last page of form an.

BTW - How many months will you be saving by not waiting one year from PR? Is is worth the trouble?

I see. Well, i have started exercising (my ex wife aswell) treaty rights in august 2006. so August 2012 is the time for BC. Hence my EEA4 still in HO hands and I dont know when it would be finished, lets say approx PR - 1.2012 (hopefully) so it would be in that case around 6 months. I think its quite a lot.

Re: Questions about Permanent Residence EEA4

Hi guys, just need to ask this question... for how long can an EEA QP be a jobseeker for?
The reason for this question is I am looking to apply for PR soon as I am a family member of an EEA national by marriage from 2010 but the EEA QP has only been in continuous employment for 4 years to date but was a jobseeker for 11 or 12 months from the date of entry in the UK and never claimed any Jobseeker allowance during this time therefore never registered. These 12 months also includes the three months unrestricted stay stated in Article 6 "Union citizens shall have the right of residence on the territory of another Member State for a period of up to three months without any conditions or any formalities"

I don't mind waiting but why wait if I can get it 12 months earlier?

SO please I need your advise guys.
Article 50 triggered: What happens next? What Brexit means for EEA nationals.
