The Home office still managed to make a mistake on my husband's name on his COA when sending correct name on application form and passport...
I guess I'll need to send them an email asking for a correction and a new COA...???

i hope u did supply the employment contract from the other state(ireland) because as a returning resident,u are not obliged to supply what u are doing right now in the uk,but what matters only is what u did in the other state,because u can't exercise your treaty right in your own country and u are regarded in the uk as a self sufficient when it comes to show u are a qualified person on arrival after the initial 3 month residency as it should be if u were an EEA citizen.chursy wrote:I provided the following :-

REcieved COB - 25 March
Request passport return - 29 March

You use photocopied documents for appeal, NOT originalchinouk wrote:I believe you can either appeal or re-apply. How can you have original documents for both applications.

No there wont be any mix up. Everything is logged to the UKBA database. So the caseworker will know if you've appealed or not.so if the new application is accepted they may write you to withdraw your appeal.chinouk wrote:Wow, Thank you I thought both need original, but if u win both case, not confused case worker?

As for appeal, you can't send in new documents. You can only send them documents you have in your possession when you applied(i.e. before the decision date) and these have to be photocopies. I also want to re-apply but through self sufficient route (through my employment), because my wife is on maternity leave and she didn't qualified for maternity paye. But when I applied she was working at that time. My solicitor said they will decide based on previous status.
And If I re-apply they may argue that I don't have right to work as my PSW visa expired now. On other hand continuity right to live and work in UK remains intact during appeal. In my case,I chose paper appeal and made sure I presented all necessary documents and explained the reason for the appeal in deep.
Anyway, I'll advise you consult with your solicitor(since you already have one) and hear what he says...
