Thats a good news. May I assume that your initial Tier1 visa was for 3years and now you got 2years of extension?

Yes it was originally for 3 years and now has been extended for another 2 years from the date of expiry i.e. 3 November.

How many times can one apply for tier 1 extension??
Can it be extended beyond 5 years??

This is what this topic is for. You can apply, but nobody can assure you on the valid till date. It will be on case workers discretion.
But chances are high to get the extension from current expiry date.
If you apply in 28days, it is for sure you will get extension from current expiry date.

As per my experience if you apply with 3 months of your expiry date you are likely to get the extention from current expiry date.. Anything beyond 3 months from the date of decision.

I have read this topic from beginning but could not reach a solid result. Some people claiming they got early extension but the extension was granted from the date of expiry of their initial leave. However there are people who are convinced that the extension will be granted from the date of decision.
Q1: Is there anyone who has contacted UKBA and asked any clear cut answer to this?
Q2: My initial leave is expiring in May 2013 and I am ready to apply for extension in January 2013. Or I can wait until April so that my application would be within 28 days and I do not have to apply for an extra extension. My question is; What are the advantages and disadvantages of early extension application?

I'm sorry none of this is making any sense what so ever.
My initial tier 1 general expires 21 Dec. Got appointment at PEO 27 Nov.
I just called UKBA and asked when would the grant be given and said '27 Nov' so therefore my extension would be 27 Nov 2012 - 27 Nov 2015.
I need 5 years in total to be considered for settlement so if I were to go to my PEO appointment - I would be 24 days short!
It doesn't make sense for them to post-date a permit, they'd grant it on the day of consideration. Just seems like a loop hole to get you to apply for another extension prior to settlement.

Hi Sezzoh,
If you call and ask them they will tell like that only. But in most cases the visa extended from date of expiry if you apply within 28 days. Only one case was found where he was given from date of application even though he applied in 30 days before.
Well, again it all depends on your luck.

Hi,
My visa is due to expire on 18th Jan 2013, 28th day from expiration of visa for me would be Saturday 22 Dec and the next working day would be on Monday 24th dec. I am planning to go to PEO for my extension and I would like to get this sorted before 25th reason being my office would be closed from 25th dec till 2nd January and I might have to go abroad in Jan.
Keeping above in mind I have couple of questions I would be grateful if anyone can guide me.
1. First off I am confused about the 28 day rule, can anyone please clarify if it is a rule or a recommendation ?
2. I have read the guidance note it says that "we encourage at least a month before..." so where did we got the figure of 28 shouldn't it be 30?
3. I have couple of colleagues who applied in Aug/ Sep 2012 (both went to PEO) at least a month and a half before there visa was due to expire.They both got their visas extended fom the date of expiration not on from the date of application. So is this 28 days thing been introduced recently?
4. Does any one know if 24th Dec is working day for UKBA
5. I have heard that if CW asks you to provide any additional doc/ proof/ supporting evidence they usually give you 14 days. In my case since the Christmas holidays will be starting from next day would they still give me 14 days? Or would they consider holiday period and give me some extra time. I am not expecting this to happen as my case is quite straight forward but just thought it would be better to know.
6. If I apply on Friday 21st Dec (29th day from date of visa expiry) and request CW to grant me extension from date of expiry rather than date of application in your opinion what are the chances they will listen to my request?
7. In case they deny me than what options would I have when I apply for ILR (as I will be a day short)
I will really appreciate if anyone could take their time out and answer the questions above.

Hi,
Will the "continuous stay in the UK" clause get broken if a Tier 1 (General) applicant is granted Visa renewal from a date when applicant's application is approved by the Case worker which was more than 28 days after the expiry of the previous LTR expiry date. What needs to be considered additionally is that the applicant filed the Tier 1 Visa extension application within 28 days of the initial LTR expiry.
example:
Initail Tier 1 (General) visa granted from 12 June 2008 till 12 June 2011
Postal Application for Visa extension submitted on 2 June 2011
Tier 1 visa granted (Biometric card issued) from 14 July 2011 (creating a gap of 32 days between Visa expiry date of 12 June 2011 and new visa valid date of July 14 2011)

Hi Sachin,
When the application is posted, you will be under the same Visa until you hear the outcome of the application. So your continuous stay does not break, infact you are benefited with this. You will have more time for your ILR application in future since your total visa period will be more than 5years.

Hi,
I am in Tier 2, got my visa in June 2011 valid until June 2014 and have to go for extention for another 2 years in 2014. But I will be eligible for ILR on 10 years basis in Dec 2014.
Instead of waiting till June 2014, can I extend my Tier 2 visa now for another 3 years which will be helpful for my child who turns 18 next month to maintain the dependant status till getting eligible for ILR.
I am not sure whether it is allowed, when I have another 15 months Tier 2 validity.
I request the forum experts to advice me on this issue as I have another 10 days only to decide.

hi
i applied for tier 1 extension on 22-02-2013 and HO received my application on 26-02-2013. my current leave expires on 23-03-2013 as per UKBA guidelines sent application at least a month before expiry of visa but visa officer issue visa on 18-03-2013 till 18-03-2015 BRP due to which i short fall 5 days for my ILR. i wrote to case worker but she replied this Thank you for your letter dated the 25 March.
The published Tier 1 guidance advises applicants that they must submit their application at least a month before their existing leave expires, but also warns applicants that the UK Border Agency grant leave from the date of decision. As a result you can have had no expectation that any leave granted as a result of this application would be added to the expiry of your extant leave.
We hope you find this satisfactory.
i am confused as if i applied for ILR they will refused my application due to 5 days short mistake done by visa officer. need help what to do? do i have to appeal against decision then need address to send appeal or do i have to apply ILR before last week of expiring my visa on 18-03-2015 so that when they make decision will cover 5 days. please help

I had PEO on 28-mar-2013 for my tier 1 General extension,before 26 days and case worker issue my visa from the date of appt 28-mar-2013 to 28-mar-2015 and my first visa was valid from 23-apr-2010 to 23-apr-2013, looks like i have shortage of 26 days for 5 years , i did ask case worker but she said that the procedure and told her im not extending my leave before more than 28 days but she did not listen me.

Hello guys ,
Just to let you know that i have discussed my case with three different solicitors and they all said same thing that i will be eligible for ILR within 28 days period which means i will have only two days (26th Mar 2015 and 27th Mar 2015) windows to apply ILR.
Thanks At least i can qualify for ILR and i don't need to go for another extension.

Vegeta,
The simplest answer of your query is that you can apply for extension at any time as long as you are meeting their points requirement.
But also bear in mind if you apply prior to 28 days of visa your current expiry date then your new visa will start from the date when they make decision not from the expiry date of your current visa.

Hi
I got Tier1 visa for 3 years on 6th November 2008.
But i entered into the country very late after 14 months(on 9th January 2010).
Got my 1st extension which is valid till 6th November 2013.
Now i am planning to go for an extension. Please suggest whether it is okay to take PEO sometime around mid of August 2013?.
It means 3 months early(as i will be eligible for ILR after 14 months).

If anyone in confusion state to apply for early extension , Just to let you know i applied for my second extension which is due to expire in Nov 2014 (i.e applied 1 year 3 months early time) I have got approval without any problems. Why I applied early is due to some personal commitments to show for my new project/client.
but i strongly suggest everyone , apply early if its necessary situation like me don't take risk for paying 1950 GBP.

Hi Sairam,
Did you provide any document to show why you need early extension ??
I want to go for early extension as well (by 11 months), It is my second extension. I want this so that my new born child get the new extension date, other wise I have to apply again after 11 months for my kid.
My kid need to travel to India this January 2014, so it would save me 1134 GBP if I did my extension first, then for my son.
