Hi guys!

Well our local MP sent us a reply today:-). Im quite impressed with the swift response. These are the contents of his letter to us:

"Thank you for your email.
As neither of you are UK nationals your applications will take time to process. Is there a particular reason you are anxious about this? I know from experience that I'm not likely to have any influence on the Border Agency's processing times and indeed sometimes an MP's involvement can actually delay matters. That said, if you wish write me to chase this I can. Could you first though let me know your own immigration status? If you are not sure, if you let me have your Home Office reference number, I can check."

So we will be getting back to him with all the information he needs and hopefuly he will chase it up for us.

We will be calling the HO tomorrow to find out whats happening with our application. Im guessing our application is still collecting dust and not been assigned to a case worker bla bla bla...

Lets keep the faith and the pressure!!

Well in our letter to our local MP we pointed out that we know that the HO cleary stipulates in our Certificate of Application letter that our EEA2 application could take upto six months ie July 11 (for our application), but our main concern is that our application has not even been assigned to a case-worker yet and it has been in their possession for two months now. We also mentioned in the letter that we have been in touch with other EEA2 applicants on this particular forum and read other immigration forums on the internet on this topic and have noted that the HO in a lot of occasions has been unable to process the EEA2 applications within this six month time period so we need the MP to assist us in chasing up our application to make sure that we will not become victims of this unnecessary delay that others have experienced.

So we hope our local MP will see our points and try to help us somehow.

Thats our news so far so we'll keep you posted.

Yesterday I sent a very similar letter to the Minister of State for Borders and Immigration, Phil Woolas MP. I know he's not my local MP, but he is in charge of the UKBA, if i'm not mistaken.

I told him that I was aware of the Immigration Regs 2006, and that the UKBA is legally obliged to issue RCs within 6 months. I told him that I was aware from reading these forums that the UKBA has been breaking the law by exceeding the 6 month limit, and that many applicants had to get help from their local MPs and Solivt just to get their cases resolved. I let him know that this is not an acceptable situation, and that I was aware that steps had recently been taken by the UKBA to clear their backlog and "get back to service standards". I told him that my wife's application has been in the UKBA for two months, and still is not assigned to a caseworker, so clearly the steps being taken are not being effective.

I pleaded with him to look into the situation, as we feel like we are imprisoned, unable to make any definite plans for the short-term future (Myself and the wife are invited to a birthday party in Ireland, but unable to book a hotel or flights until we know for sure if we can travel).

Nice one Doesntcompute so you have gone straight to the boss Phil Woolas himself thats great please let us know his response! We will also follow suit and send him a letter too!!

Our application has also been at the HO two months now. But we are not waiting around until the 6 months are up to be told some sob story... we will put as much pressure as we can to make sure our application is looked at asap and hopefuly get the desired result!!

Its true that our being made to feel imprisoned like this is just not right and the HO process of dealing with our applications is flawed!! My husband and I also have major holiday plans in July and in Sept with our family and friends but we cant make any confirmed flight bookings, hotel reservtions etc because of this waiting around! This whole thing is very distressing!!

Forza - the HO wrote to me on 30 November requesting further evidence that my sponsor and I are living together. I have heard nothing from them since.

I got my RC! I'm so relieved.

I sent them one letter by fax to request that my application be expedited on 4 March, citing several reasons, and my RC is dated 5 March. My 6 months was up on 14 March, so I'm pleased I didn't have to wait as long as a lot of others.

Now I'm going to book some holidays.

Many thanks to everyone for their invaluable advice. If it weren't for some people on this board I would not have attempted to enter the UK without an EEA FP and I definitely would not have submitted my EEA2 application (I was planning to go back to Australia and apply for a spouse visa).

I got my RC! I'm so relieved.

I posted here last year under a different username. Well its been 6 months for us, (EE2 application posted 10th September 2009, COA received September 15th) Called them today and all we got was 'still under consideration'. Why can't they say something more useful?

Neither me nor my partner have seen our families for over a year. I can't seek employment until this is resolved and all our travelling plans are at a standstill.

So I'm definitely going to start sending out letters to mp and complaints services. If anyone had any successes with this or can recommend a contact please let me know;)

Its just ridiculous to hear that some people have waited for 2 years. I'm from Russia and even with their bureaucracy things don't take this long.

Its good to be back with fellow internationals. Lets hope for the best;)

Neither me nor my partner have seen our families for over a year. I can't seek employment until this is resolved and all our travelling plans are at a standstill.

So I'm definitely going to start sending out letters to mp and complaints services. If anyone had any successes with this or can recommend a contact please let me know;)

Its just ridiculous to hear that some people have waited for 2 years. I'm from Russia and even with their bureaucracy things don't take this long.

Its good to be back with fellow internationals. Lets hope for the best;)

Why you cant seek employment? That COA which you received must give you the same rights as your husband during time HO considering.

Hello EEA2 warriors !

Update from our local MP. He replied to our second letter and has sent a letter to the MP liason department of the UK Border Agency unit in Croydon to the attention of a lady down there. His letter explained to the UKBA that we have an EEA2 application lodged with the UKBA since 11th January 2010 but we havent not received any word on the processing of our application etc. He explained that we need to make urgent travel plans this summer so if they could endeavour to get this sorted quickly...

He attached the letter to her for us and he says that as soon as she replies to him regarding our case she will let us know and keep us posted.

Im glad our local MP at least has taken the time to help chase up our case for us by using his contacts. So we will wait and see.

Why you cant seek employment? That COA which you received must give you the same rights as your husband during time HO considering.

While we were waiting my previous visa has expired so apparently I can not legally seek employment until the residency card has been issued. The previous visa was limited to two years so I could not get it renewed. As far as I know the COA doesn't give me any additional rights, it is just a confirmation of my application, or am I wrong?
