Initially I know some Article 8 applicants also had applied for Zambrano and vice versa but recently someone posted somewhere that HO asked them to choose an application to withdraw and the fees would be fully refunded as one could not have Zambrano and FLR(o) pending at the same time. You may need to check up on that claim as the poster never confirmed when both applications were made.evie233 wrote:Is it possible to put in an article 8 application while I have an application pending? Basically I filled the FLR (o), especially ticked the 'parent in the UK' and sole responsibility boxes. Your solicitor have to explain in the covering letter how you are the carer for your child. Mine argued Article 8 and 3, ZH Tanzania and Zambrano. EX.1 is for single mothers/parents so be careful as applicants who are still with their partners are being refused. My solicitor even mentioned my Zambrano refusal as well as the Secretary of State suggesting FLR(o) paid application. Documents i submitted were same used for Zambrano application. Tribunals Customer Service Centre on 0044 0300 123 1711. call having ur home office reference number with u so u quote it to them. all the best
I called them and gave me my court ref no, but the hearing date is going to be next year may or June terrible. I fink while waiting why don't you apply for the article 8 that is what I have done. If I may ask have u gotten ur hearing date? If not I will advice u to find money and do the flr(o) cos that is fast. My hearing date is 18th November but I am still doing the article 8. A lot of pple are doing it and I would advice u do like wise rather than waiting. Do u realise we didn't hear from kofi? It is because Zambrano is not as easy as we fink. It's just an advice. I saw my lawyer and he have done it.
