Switching -Tier 4 Student visa to Tier 2(General)Dependent

Hi all,
I am currently studying here in the UK with visa Tier 4 General Student Visa. My Spouse who is currently working as Tier 4 Dependent visa is eligible to apply for Tier 2 General with her employer from inside the UK.

My questions is that :
Can I switch from Tier 4 General Visa to Tier 2 dependent visa inside the UK? Can my spouse apply for Tier 2 dependent visa for me along with his application inside the UK ? Or is it required to go back to home country to apply for Tier 2 dependent Visa? Any advice and more information is highly appreciated.

She can switch into Tier 2 from inside the UK. You will have to apply from outside the UK to re-enter as her dependant.

Thank you very much for the response. Just to confirm, my wife can switch to Tier 2 General from Tier 4 dependent within UK where as I need to apply from outside UK to re-enter as her dependent. Am I right?

I have an additional question with respect to my wife's Tier 2 General application. As per new rules, her application comes under restricted category where her employer has to apply for Certificate of Sponsorship under the monthly quota and pass the residence market Labour test.

Since she is already working for the employer for 6 months and she is applying for her Tier 2 general in order to continue with the employment, how can her employer pass the residence market labour test?

PS: Residence Market Labour Test is show that there is no suitable settled worker who can do the job and we have advertised the vacancy for 28 calander days.

Please let me know if you have any idea? Thank you.

they would need to advertise the job as explained in the guidance.
