Query About applicant residing away : ICT2

Post by sewatkar » Tue Apr 17, 2012 9:43 pm

I needed some information about the below point in the PBS Dep Policy Guide.

Background : My wife went to India in May 2011 when were expecting our first child. Her parents took care of her. She was in our hometown where my and her parents also live. We applied in Mar 2012 but since I had submitted my online bank statement our application was refused citing low maintenance fund. I heard that the process has become really strict these days so I read the complete PBS Guidance; one of the point is below. I think my wife would fall in this category as she was living away from me. In the covering letter that I am going to provide; I am going to state that she went to India when she was expectant and her care was taken by her parents. I plan to submit my Father-in-laws statement for the below point. I have enough funds in UK bank, going to share our Skype Call records, E-mails, Facebook Chats, my transfers statement from UK of my Indian bank and some other docs, but now I am worried about this one.
110. Where the applicant is residing separately from those on which he/she is claiming to be family member the following information or documentation should be submitted:
reasons for residing away from the family home. Where this is due to academic endeavours the • applicant should submit:
confirmation from his/her university/college confirming his/her enrolment and attendance of the • specific course. This should be on official headed paper and bearing the official stamp of that organisation. It must have been issued by an authorised official of that organisation.
The applicant should also include evidence that he/she has been supported financially by his/• her parents whilst residing away from the family home. The following documentation should be included with the application:
bank statements for the family member covering the three months prior to the application • clearly showing the origin of the deposits; and
bank statements for his/her parent covering the three months prior to the application also • showing corroborating payments out of his/her account.
Query : Could anyone please share their thoughts on the same and their experience in such a case for ICT T2 Dependent VISA. Would submitting my Father-on-law's bank statement be good? I have transferred money to my bank account but not to my Father-in-law's acount, he won't take it. Her care was taken by her parents only though she stayed with my parents as well for some time.

Would appreciate if someone could appraise on this situation. Thank You.

the section you have posted is about children not about spouses.

You can't rely on your father in law's funds, the funds either need to be in your name, your wife's name, or joint names.

THANKS !!

Post by sewatkar » Sat Apr 28, 2012 10:49 pm

Many thanks Geenie, truly appreciate it.

I won't submit my Father-in-law's bank statement then. I have more than 3000 GBP in my UK current account and nearly 2000 GBP in my savings account which I believe should be sufficient right ?(calculated on the basis of 533 X 3 + 800 ~ 2399). I am submitting all of these - my UK bank statements in original for the last 12 months + 12 months Salary slips + Maintenance Letter from my UK HR for my dependents + letter from me inviting them +our communication proof as above + some other docs as well like my COS copy + My Passport Copy all pages (Self Attested) + BRP Copy(Self Attested) + Marriage Certificate + Baby's birth Certificate + My Original Degree certificate + Covering Letter from my India HR + India HR letter confirming my parent's address in India for my wife and daughter as my their passports are not issued in Mumbai + My UK tenancy agreement + UK Utility Bill + Maternity Hospital Discharge Card. I feel I am covering all of it still I'm scared :(

Hope this time VISA is granted successfully and I am able to see my family in UK. Thanks again for your time. Have a nice day.
