Possible to have 2 visa applications in process together????

Post by Jungleside » Thu Apr 19, 2012 1:45 pm

I am in need of some advice and I hope someone can help.

My husband (from Sri Lanka) has applied for a UK settlement visa and it was refused. We have put in for an appeal and I (his wife -British) have returned to the UK to work and attend a possible tribual.

We are wanting to know if it is possible to apply for a family visitor visa now even though we have the settlement visa still in process.

If anyone can please help with this enquiry as quickly as possible it would be very much appreciated.

Regards x

He can apply for a visit visa (with or without a pending appeal) but there is very little chance of this being approved. He's just been refused a settlement visa so have already declared that he has no real ties to his homeland that would motivate his return after visiting the UK.

Thank you for that. I guess he has declared that he is willing to cut ties in Sri Lanka if the settlement appeal is approved, however he has not yet cut ties. He is still working, would have a job to go back to after 4 months here, a tenancy agreement on our house, our dog, and much more evidence we could provide. Plus my residents visa expires there in October so I woud more than likely also return with him and we would continue to live in Sri Lanka until our appeal is decided.

Again I ask do you think it is worth our while. Can anyone comment on reasons why people have succeeded or failed to get a family visit visa?

What about human rights??? Quality of family life???

Thanks x

The application is only 78 pounds so no big deal if it fails.

 they will limit their length of stay in line with the requirements for visitors
 they will leave the UK regardless of the outcome of their appeal
 they meet all of the requirements of the rules for entry as a visitor.

A person arriving at a UK port with an outstanding appeal still has the right to seek entry as a visitor.

You must consider the following when deciding if an applicant is genuinely seeking entry as a visitor:

 Does the person still wish for their appeal to go ahead? This may clarify the true purpose for their visit.
 Does the person intend to leave the UK?
 Is the person credible and what are their intentions?
 Has the person given any undertakings or guarantees?
 Is the duration of their stay in line with the visitor requirements?
Substitute "arriving at a UK port" for "applying for a visa".

Seems like a tough one to satisfy...
