Can my Fiance get 3rd party support from her parents?

Post by newlight1 » Fri Apr 20, 2012 10:09 pm

Hello,

I am sponsoring my Fiance with a fiance visa and she was wondering can her parents offer 3rd party support?

Also can she include in the Fiance Visa application property she is 1/4 entilited too from her fathers properties she owns?

Yes, her parents can assist. The fact that she has a part share in non-liquid asset of intangible value will not be considered for maintenance.

Thanks, so her parents even though her parents are in her native country in Albania can write a letter to offer financial support and supply copies of their bank statements?

But the property would not be considered that she has a 1/4 entitlement too. Maybe she could get a release of equity possibly.

No, I did not say that. Where does Albania appear in your first post?

Maintenance has to be cash or income. Assets such as a house (or a valuable gold watch) are not acceptable.

Hello, ok so her parents can not assist and offer financial support because they are based in her native country?

Can her savings count towards her application? Maybe if she can get any kind of equity release from her share in her Dads properties?

Thanks, and can you tell me what her parents would need to show to show 3rd party Fiancial Support? Copies of Bank Statements, Savings? and a letter? Would the bank statements have to be originals? Certified etc?

If the parents are not resident in the UK their offer of 3rd party financial support will be rejected. The ECO will not consider the parents equity in property either....as the advice already given by Lucapooka. Her savings will be considered if substantial, but the ECO will prefer to see that the sponsor (you) have regular income which meets the minimum weekly financial level of £105.95 for a couple after rent or mortgage, council tax and any loan/credit repayments.

I checked the guidance and it does say that members of their 'families' can provide third party support, not specifically UK family members
A couple or other applicant who is / are unable to produce sufficient evidence to meet the maintenance requirement may provide an undertaking from members of their families that those members will support the couple / applicant until they are able to support themselves from their own resources.
But I think it should be refereed to non-UK family as a source of income rather than a sponsor. I would have thought if the money is available and it's genuine, then it wouldn't matter which country it comes from.

If the overseas sponsor defaults on financial support during the 2 year period, how would the UKBA enforce payment outside of the UK? :?

does anyone know if this option is still available or will the government remove this co sponsor type of 3rp party financial support
I am in a position where i will require my parents to sponsor my wife in the visa application.

Also can Both of my parents sponsor in the 3rd party support or only 1 of them.

I would like to know because i am waiting until june to see what the new government rulings will be. any information if the income band will be definately £25000?
