Please I need help. I live in Spain and am a family member of an EEA national and wish to visit the UK with my wife (EEA national) and my son (from another mum). I applied for EEA family permit/visa for myself and my son but the embassy only granted my application and but refused to grant a visa to my son. This is their reason for denial: "I therefore refuse your EEA family permit application because I am not satisfied that you meet all of the requirements of Regulation 7 of the immigration (EEA) Regulations 2006"
My son (2 yrs old) was born in Spain but I have not yet applied for a resident card for him. Therefore I included a family book and his birth certificate to the application along with other supporting documents. I am not sure why he was denied as the family members of an EEA national are defined in regulation 7 and regulation 8 of the 2006 Regulations as
• Spouse / civil partner (excluding a person who is party to a marriage or
partnership of convenience - see Chapter 5 of the ECIs).
• Children of the EEA national or of his/her spouse / civil partner who are:
• Under 21; or
• Dependants
I want to appeal against the decision but don´t know what exactly I should state in the appeal.
