Application as a general applicant while married to BC

My husband filed for Naturalization and got British Citizenship last year. For some reason, I did not file with him. Now I want to file for citizenship but my husband refuses to provide me with copies of his passport and citizenship letter.

Can I file for citizenship as a general applicant although I am married to a British Citizen. I meet the residency requirements and have been in the UK for 8 yrs now. If yes, how should i specify this information in my application.

You can apply based on your own merit. There is no need to state that. If you don't provide evidence that you are married to a BC, you will be treated as someone who is not (5 years residence period, 12 months from ILR).

If you wish you can state on page 13 that the application is made under section 6(1) which is the relevant section for "not married to BC" in the British Nationality Act.

Why isnt your husband willing to allow you to borrow the passport for a couple of hours?

Ultimately you dont need him to sign the form, you would just need to book your NCS meeting with the council and take the form and documents there and you leave 45 minutes later with your (and his) documents.

I am not sure I would go as "technical" as Jambo says but certainly in the other information section I'd mention that it is not possible to provide your spouses documents if you arent able to "borrow" them.

Personally I would be more concerned about my marriage than applying for BC at this point
