UK born child, applied for registration, URGENT travel need

Hi,

Please could I request for some guidance here.

I am on the ILR and my child was born before the ILR. I recently applied for his registration (3 weeks back) through NCS. His current visa is Tier 2 dependent due to expire on 16th May 2012. I did not apply for his ILR / FLR(M) as he is entitled to the citizenship.

We need to travel to India due to some family emergency. Please could you advice what options are available in terms of the child's visa and his visa status.

How long is the trip for? Will he return with you or stay in India?

You should have no problem leaving the UK. It then depends when you plan to come back.

He will return back to UK. Stay will be for 3-4 weeks.

Tricky.

I assume that if this is a family emergency, you plan to travel soon.

The Registration application is probably going to take 2-3 months (those are the figures from recent timelines). Even if the Registration certificate arrives while you are away (and someone can pick up the post a send it to you), first child UK passport in India can take more than a month. Applying for a child settlement visa can also takes several weeks.

Is the child travel essential? You might need to spend a longer period in India until he receives a Registration certificate and a British passport can be issued.

Hi, many thanks for the advice.

Yes, his travel is necessary as the child is just 3 years old and will not live without his mother.

Is there any option of temporary visa, etc, for the young children please?

You can try and explain the situation to the BHC and apply for a visitor visa although there is no guarantee this would work.
