Child abroad and Absences -residence requirements

Post by starxrose » Sun May 13, 2012 4:54 am

My son, who was my Tier 1 dependant, is currently living with my parents outside the UK In order to attend school. Prior to this, he lived in the UK for seven years as my dependant. I now have ILR and wish to apply for ILR for him and then register him for BC as he was born outside the UK.

For his BC, what is the situation regarding his absences?
The plan is for him to stay 9mths out of a year outside the UK and return for 3mths every year.

1. Does a child have to meet residence requirements?
2. Would the application be refused due to spending over six months outside the UK per year?

All advice and suggestions are much appreciated.
