I just want to know which part of UK u have your hearing.

Actually i am looking for long hearing dates but when i see your appeal timeline i am bit shocked that u submit appeal on 6 june and got hearing in early september.
Is that a paper hearing or oral one?

An update to mine is that the amoebas have asked me to withdraw JR without costs and they will reconsider and if they refuse again, they will issue removal directions.

As others have said sign to avoid delay, however, am sure that If you insist that HO will bear the cost another letter will be sent out to you accepting to bear the cost. Just of recent I come across someone in sure a situation and the treasury solicitor agree that HO will bear the cost. But left for me I will sign and let go.[/quote]

@icehouse256, thanks , yes its first application , me and my daughter is British . but was living in pakistan . Due to my daughter's sever health condition we move to uk . my husband came as visitor. we did apply in 19th may done bio on 31may HO brp letter on 21st july .
they state your Brp will come in 7 days.

Hi Friends,

My wife's FLR FP application (10 year partner route) has been refused today with no right of appeal. We would like to go for JR. How soon you guys suggest we should send a PAP? My solicitor said we can send one in 3 months time.

My wife is 20 weeks pregnant and i am an ILR holder. My other query is if she goes back to her country and applies for entry clearance as a partner will the time she spent here as over-stayer will be a problem??

Brief history of her case:

She came here as student and applied for FLR O application in October 2012, received her refusal in October 2013. She appealed against the decision (5th Nov) in allowed time, Received appeal decision in Feb 2014. Appeal against the First tier tribunal decision in upper tribunal in Feb and received refusal decision on 12th April 2014.
She applied for FLR FP on 01-05-2014 as i didn't meet the financial requirement of FLR M application. Received refusal today.

Now i have a job and i meet the £18600 requirement but i have just only started my job. I have never claimed any benefits.

Please if you guys can advice us it will be Much appreciated.

Hello March_LR14,

Welcome to this forum. I have someone in a similar situation as yours too though her husband is British and the wife is pregnant too both their application and PAP were refused by the home office as they are claiming pregnant women can still travel until they are 36 weeks. I would suggest that you don't go for JR just lay low till your wife gives birth and the baby will be British since you have Ilr which will make life more easier. Good luck.

@March_LR14: Sorry about your wife's refusal, i want you to hold tight to your faith and believe that this is just a delay but not a denial, because surely your wife will be granted, it will only take time which is what the HO does to frustrate couples, but don't give up because God is fighting for you already. Can you explain on what basis was she refused, what is the exact reason(s) stated on the refusal letter ?

Also i suppose that she no longer can apply for the route flr (M) even if you now meet the financial requirement because she has no valid leave (gurus please correct me if i am wrong). My situation is similar to yours, and after i was refused in my first application, i had to reapply under the FP route because i no longer have a valid leave, the only different was that my wife now meets the financial requirement when i made the second application. Still awaiting my BRP and documents,I applied 2 weeks after your wife.

March_R14 - sorry about your wife's refusal. As suggested by icehouse above, could you please share the reasons why she was refused! Rather than we speculate & attempt to assist you without the proper facts. I fear you may have fallen foul to the dreadful £18000 threshold ruling. Please do not be disheartened as you now meet the income threshold criteria. Extremely positive news so happy for you. As you can tell it doesn't take much to excite me! Seriously, your circumstances have now changed and that could be a 'game changer'

Now to the mundane procedural nitty gritty! Formal notification/letter before claim which is in the form of a PAP should be filed immediately after a refusal and should you not receive a favourable response within 14 days, you may proceed to filing for JR. The entire process MUST be completed WITHIN 3 months of the refusal and NOT after 3 months - I am very confused as to why your lawyers advised you to file for JR in 3 months time.

Reason for refusal:

1. You have not lived here for 20 years.
2. You not 25 years of age and not lived Half of your age here.
3. You do not have a kid who is british citizen OR who is living here for past 7 years.

4. They acknowledged that she has a genuine and subsisting relationship with me. They said your husband has been living here for over 10 years and in employment here and we expect that he will experience certain degree of hardship in relocating but there is no insurmountable evidence that you cant continue your genuine relationship in your own country.

Apart from the above they said her leave to remain expired on 19th April 2013 (which is not true she applied Flr O in october 2012 when she had leave to remain which got refused on 22 oct 2013, we appealed against this decision in allowed time, she received her final appeal decision on 12th April 2014, she had 3c leave from Oct 2013 to April 2014) u lodged Flr FP application on 01-05-14 without leave to remain.

They advised her to contact local enforcement team by 05th August to arrange for her exit of UK.
Otherwise they may take enforcement action. She is very scared right now and we don't know what to do.

Regarding formal notification letter do we need to hire a solicitor? OR we can do ourselves. If yes is there any template we can use?

To meet financial requirement you need to show them 6 months payslips and i have started my new job last week.

Hi all, I am new to this forum and have had great pleasure in reading all of your success stories, congratulations.
However i was wondering whether you could now help me possibly with some advice as to my application, I am a 21 year old male who was granted Discretionary leave in 2011 as a dependent under my mother, this expired this year in May and i have now had to apply individually as i am over 18 years old now.

My time line is below;

DL application - 15/04/2014 (visa expired 05/05/2014)
Application acknowledgment received - 03/05/2014
Biometrics: waiting
Biometrics done: waiting
Decision letter received: waiting
BRP Received:waiting

Essentially my question is, is there a longer waiting period for my type of application in comparison to FLR?
Is anyone else in my unique position of moving from a dependent to an individual ?
Will the fact i am not my mothers dependent weaken mine or her application ?
& Is my above timeline typical of DL applications (tried scoping through the blog to find DL application

Afternoon all - @March_LR14, a solicitor certainly numbs the emotional pain & stress but they don't come cheap. If you have the resources then I would advise you to use one. It's not unprecedented to do a PAP yourself but you would need to research the relevant case laws & legal arguments applicable to your wife's situation. Hopefully someone with a similar case can assist you with a template. All the Best to you.

@Manirem, welcome. in an ideal and properly functional system, I would like to believe that whatever your mother gets you should get the same too but we all know nothing is ever straight forward with May & co, again depends on the conditions your family was awarded DL. Extensions of late have been having a turnaround period of 6 to 9 weeks but we are all too wary there is no set way of handling cases with the HO so may take longer or less. I would make a terrible speculator as you can see. Sorry can't be of much assistance. Keep the faith though!

My soli contacted tribunal and tribunal said they have back log and they are currently dealing with appeal dated 9th July and my soli submitted it by special delivery one day before lasts day of appeal

As a result my appeal is not yet processed

That's why home office saying no right to work
