@neilmarques your wait is finally drawing to a close-very encouraging indeed. Congrats to collins123 and imensah. Commiserations to AfricanThunder perhaps you can draw strength from collins123 situation and continue to fight your case!

The new Immigration Act to best describe it is an entangled myriad of unnecessary clauses which infringe on the fundamentals of article 8 of ECHR. So don't despair because the judiciary don't understand it fully as yet. Expect an avalanche of more Judicial reviews questioning the legality of some of the decisions - hard to take on the establishment by way of JR to contest a parliamentary act but am very confident that we will never fully understand the ins and outs of article 8 and ECHR perhaps this is where God steps in for us believers!!! Hello everyone,

Congratulations to all those who got their stay. Please I urgently need advice on Extension of my DLR. I was issued Dlr in october 2011, I am seperated from my wife (but still legally married), we have 2 kids (british, including my wife). I work full time and earn over 30k/year. I pay her maintenance, everything concerning their schools and holidays. I see the kids as much as I want and my wife gave me access to their birth certificate and everything I will need to apply for my extension.

She will be writing a cover letter for me as well, plus we have been attending counselling as well and our counsellor is writing a letter too, because not only are we working on our marriage, we seriously planning on moving in together again.

My situation is still the same the only thing changed from last time is the fact that we decided I should move out temporarily while we work on the marriage as we were arguing too much and was affecting the kids.

My questions are:

Will the home office see this as change of circumstance to want to refuse my extension?

Should I consider using a lawyer or applying myself? I really want to not involve a lawyer only if it will be seen as complicated.

Please any advice will be greatly appreciated. Thanks alot guys

Very happy for imnesh and collins. Congratulations, . I applied flr fp as an 7 years overstayer husband of british citizen and father of twins. Its been 4 weeks since done biometric hopefully its our decission time in next coming weeks.

Congrats @ Collins, it seems like they are now working on applications based on dates applications were received. But still weird how applications made in May are still pending / waiting on the queue. But I'm really happy for you and Imensh.....Hopefully soon all of us still waiting will our good news. AMEN.

Some times it's worth giving them a call on 03001232241 option 4 (progress of application) in my case, once I made 8weeks on 05/08/2014, I called and after waiting in the que for 20mins I was informed my case isn't yet decided I should continue to wait. I reminded the advisor of the 8weeks processing times on the web site but challenged me that its just a guideline. However, just after a day in between, I received my BRP. If you're sure you're application is well over due, try giving them a call. I am sure it's not a criminal offence. I pray you get your freedom soon. God is with you

Yes collin i did rang them today and asked bout the status of my application which after holding the line for nearly 25 minutes and once connected confirming my case id , application type (MENTIONING DLR) my name, nationality, birthday , middle name and address I've been told still not decided. @Giveita100% welcome and sorry to hear of your marital problems. Your wife is willing to draft you a supporting letter to help your application, your counseling sessions are documented plus you are legally still married and hopefully there is no Decree Nisi /Absolute in place, then that hardly constitutes as a significant change in circumstances. So In my OPINION you are fine to go at it alone. Good to seek a legal representative's opinion of course! Good luck.

Yes she will be writing a letter and everything documented. We only seperated as advice by our church and to seek counselling as well. We will be moving back together hopefully couples of weeks. I have been paying the rent even though I dont live there. She was initially on housing benefit. My mails didnt change, I still paid most of the utility for her, and everything else for the kids, like school meals and nursery for my daughter.

Ok no problem, wouldn't really know whether or not to classify your relationship as subsisting or not as it's a temporary separation so not sure how to consider your situation it's one for the lawyers or equivalent. Gut feeling says you can do it yourself still. All the best

I know, that part of classifying my relationship is the hardest. But im hoping it will all turn out well when the time comes. Thanks alot for your kind words. Sincerely appreciated.

It was exactly 8weeks from the day I posted the application and 7weeks from biometrics. You will succeed in God's name. Be strong and don't lose hope. My prayers for you and everyone waiting. There's nothing emotionaly, mentally and physically draining in this country like waiting for your status.

The way I look at your situation I can only say you're safe. My case almost was the same as yours. Technically we are still married but separated. My now ex didn't give me access to my child's documents to support my application. But she wrote a letter to the home office stating that our marriage broken down but she allows me to see the child (Access to the child). This is a requirement and if you can't obtain it from your partner then, you may be required to get a memorandum of understanding from family mediators or contact order from court. You may have to prove to the home office that you no longer have a relationship with your partner. Please gather all proof for contact with the children and maintenance. Then don't forget at least a letter from your work place. Explain your circumstances in your cover letter. You have a Job with a great income. Considering my successful application which was abit of a gamble, You're definitely on a very safe side. I dont think you need a lawyer. But you can seek more consultation just in case. Save that money for celebration.

I have ILR(10yr) and my dependents are in PBS dependent visa. Though I have a job now to satisfy income under new rule, I'm not having 6 months payslips now and my dependents visa expiring sooner. Are my dependents to eligible to apply FLR(FP) for few months and convert later into FLR(M)?

We also received a letter stating "Your application raises issues relating to the European Convention on Human Rights which are complex in nature. As such, it falls outside our normal service standards for deciding leave to remain applications. Please be assured that we will make a decision on your case as quickly as possible."

Does anyone know if this is the normal procedure and does it mean we are looking at a longer wait than 8 weeks for a decision?

It is normal as your husband applied on flr fp and it raised points of human rights article 8. Completely normal, 8 weeks or more purely on luck my timeline is in my signature still waiting for reply.

I think yours will arrive soon, I know of someone whose husband was granted recently after a 10 week wait.

I'm just a little bit concerned because I applied based on me working full time, but this is temporary and I may be out of work just after the 8 week mark.

hello everyone, i must really commend you guys for this forum, I have been following this thread for the past 2 months and I made up my mind to comment after i receive my permit. I have just been granted my extension of discretionary leave to remain yesterday so i thought i should share it with you guys as well, I was even scared but God is good, i had 3 points on my license for driving withour a full license after i had my full license i was caught out with an expired car insurance i totally forgot i had not paid for that month had too much going on, had my license revoked, got a new one again was fined for speeding but all these dont matter as long as you tell them the truth on your application form, honesty is the best.

This is completely normal. Does not necessarily means its a long wait. It just means that applications based on Article 8 can take a little longer but not always. My husband had his biometrics done on 29th of May and we got his BRP in just 7 weeks. Stay strong meanwhile. Goodluck to you and everyone
