ILR queries - WP migrant

Post by ak36 » Sun May 20, 2012 1:58 am

I will be applying for my ILR in July and am drafting an employment letter (letter to show that my company needs my services) to be signed off by my manager. However, I have recently seen in some posts that this letter should include Standard Occupational Classification (SOC) code for my position/title. I work for a big company but when I called my HR to get the appropriate SOC code for my title, they did not have a clue of this thing. Could someone please tell me how to get an SOC code for my letter? Will it be HR or my manager to find the appropriate code for my job? And also, is it really necessary to include this code in the employment letter??
Many thanks,

SOC codes is a must for tier 2 and work permit applicants, there is even a secrion in the new set O form asking for SOC and salary.
Is your job listed in the code of practice list? If it is straightforward then match it yourself and draft a letter for the employer...if it is not a straight match then the employer must match it for you as the choice of code would affect minimum salary required...take a copy of SET O guide and form to your HR department and insist that they should sort it out

SOC code for ILR Employment Letter

Post by ak36 » Mon May 21, 2012 11:44 pm

Thanks sushdmehta and legalalien.
I don't know how to check if my job is listed in the code of practice list but one thing I can be sure about is that they should not get confused with my title and job description. I work as Project Manager for a well known construction firm and my job description clearly says that I will be supervising construction works on site. I have checked a list of SOC codes that is available on the website of Office for National Statistics and can pick code 1122 for Managers in Construction for my employment letter (as per the second part of your message). However, I am not sure if that will exactly be the code for my role and salary??? see link below please. Please advise.

Hi

Try the link below.

http://www.ukba.homeoffice.gov.uk/sitec ... e2012-cop/

That's the correct link for the SOC codes as published by the UKBA on their official website and you've use among these codes find the exact matching code for your job and if you fail to find an exact matching code then I would advice you that find the nearest matching code to your job after looking at the job responsibilities.

If the Link above doesn't work for any reason just simply do a Google about "UKBA SOC Codes" and you'll get the right link.

For example I work as n Assistant Financial Controler for my company I'll use the Financial Controller code for my self in my employment letter for my ILR. That's what I've been told to me by my HR department and after reading some of the job descriptions it looks correct to me.

Hope this will help in answering your question.

Please do kindly share your PEO experience on the forum.

Good luck for your ILR.

I am going to apply for ILR in the next two months and currently I am trying to sort out my employment letter which will finally be signed by my company. I am project manager in construction and can find the perfect SOC code for my role from the 'UKBA Occupation codes of practice for Tier 2 Sponsors'. I have picked up 1122 for my role and I do exactly what has been described in the 'Example of job tasks' for NQF level 6 against this code and my salary is also in line with the required figure. The only problem that I have is that my actual job title is Project Manager but 'related job titles' in the list against this code are Clerk of Works, Construction Manager, Contract Manager and Site Manager. Although, I can use Construction Manager but that is not my job title in the company. Can I pick the same code (1122) which is more appropriate but use my actual job title of Project Manager in my employment letter??

Your prompt responses would greatly be appreciated.

Thanks,

The 5th anniversary of my work permit is on 11th September 2012 (my WP expires on this date). It might be a silly question but could someone please advise me what is the earliest date I can apply for my ILR? Is 15th, 16th or 17th August? And how early can I book a PEO appointment for my interview?

Your response would greatly be appreciated.
Thanks,

I am on old work permit (2007) and am due to apply for my ILR in August 2012 with my wife as dependant. However, I have recently discovered that UKBA has introduced new family immigration rules which extend probationary period for settlement for spouses from 2 years to 5 years. I just want to know if this rule applies to me as well or being on old work permit, I am ok to show 2 years cohabitation documents for my wife and apply for her ILR?

I am not too far from my application and would really appreciate your speedy reply.

Many thanks,
