Please can you confirm when I will be eligible for ILR:-

Visa Stamped - 11th July 2007 HSMP
Entered UK 04th Aug 2007


When I called UKBA, they said it is 28 days before 04th Aug so any date after 07th july?

darkhorse341: as sushdmehta, it’s generally 28 days before the 5th anniversary of your first entry into the UK, but under the modernised guidance , people can now apply 28 days before the 5th anniversary of their EC dates (first visa date).

Also one has to enter the UK within 90 days of getting EC to benefit from this rule.

As sushmehta has suggested I would recommend that you read the FAQ sticky post which has a lot of useful information before posting questions.

E.g.

Q16 - Maximum absences from the UK (economic migrants)
A - Number of absences is one of the most unclear and contentious issues for ILR. Maximum allowable days out of UK are total 180 days over 5 years and not more than 90 days in a single trip. Success of applications with absences in excess of the permitted limit will depend on the evidence(s) you submit to prove your continuous residence and economic activity and will be at caseworker's discretion. Only principal migrant is subject to these (absence) requirements, not dependant(s). For absences on account of employment related overseas assignments and annual paid leaves, do include a letter from your employer. A summary of absences may also be a useful inclusion.

Reading carefully helps ..... the modernised guidance, that I think you suggest isn't spoken about, is listed both in Q1 and Q16. Q16 also answers the query about dependant's absences.

But if there is any other guidance you refer to, please let us know and it will be included.
