If you don't have a passport or travel documents covering the 5 year residence period then you are required to provide other evidence of residence during the period when you didn't have your passport or travel document. So if for example you came here on a one way travel document or emergency travel doc you would need to provide evidence such as proof of jsa. Its good practice in these circumstances to provide evidence from more than one source.

Hello John,

Just to quote you from a previous post.
The legislation specifically requires the applicant to be in the UK at the start of their "qualifying period"
And also from

Guide and booklet AN (2.2)
You should also check that you were physically present in the UK 5 years (3
years if you are married to or in civil partnership with a British citizen) before the date that
the application will be received by the UK Border Agency or other receiving authority (see
page 17 “Where to send your application form”). If you do not meet this requirement your
application is unlikely to be successful.

Nationality instructions

18.2.1.2 The residence requirements referred to in 18.2.1.1 above are that the applicant was:
a. in the UK at the beginning of the period of 5 years ending with the date of the application.
Annex B (Residence requirements)
Presence in the UK at the beginning of the 5(3) year qualifying period

I need some help as all the rules seem to point to the start of period.
Could you please confirm if applicant must also be physically present on date ukba receives the application (end of qualifying period)? Any additional links will be appreciated. Thanks.

Just to illustrate:

Say I apply through NCS on 10th June 2012, and home office receives it on 13th June 2012. I thought this specific requirement will refer to 5 yrs ago from 13th June 2012? And it should be ok if I was physically in UK 12/13/14 June 2007? Please advise.

Sorry John, just used random dates in my previous.

I have an NCS appointment 1st May, but might have to go abroad later that same day!
Was physically in UK whole of 2007 except first 2 weeks of April (holiday).
Otherwise, I meet all other requirements.

What do you think? Kind regards.

Bad idea. You need to be in the UK when the HO receives your application or it will deemed as being received by the wrong authority and get refused.

Just had a brainwave (methinks!)

If I can get NCS appointment for 30th April (with special delivery, guaranteed next day), then UKBA will receive my forms on 1st May (effective application date). Am I right?...Really hope I can submit a valid application before I travel. I become eligible to apply from 1st May!.
Please respond so I can start looking for available NCS appointments. :wink:

The NCS office will use Special Delivery, and should post your application, no doubt with others, to UKBA that day, but you need to ensure that they will be posting that day.

Also, are you able to get an NCS appointment for next Monday? You might struggle to do that.

As there seem to be some element of luck in the varying processing times, I fail to see the rush to apply on the first day you can.

How long are you going for?

NCS might not accept you if you travel so soon.

Thanks John. I've checked couple of NCS centres online, some have availability for 30 April. Just need their confirmation that it will be sent off by special delivery same day before booking. Getting on the phone rightaway. Will update soon.

Am not too worried about processing times. Away for 2 weeks. But just trying to get the application in before Legal Aid, Sentencing and Punishment of Offenders Bill is passed. (Hence my rush). As I'm not sure how spent convictions will be treated by UKBA. Thats another topic anyway. Regards.

Booked my NCS now. Guaranteed to arrive UKBA as required.
Fingers crossed, I'll start posting to the "timeline thread" from monday, 30th April!.
