Naturalization based on PR

Post by afsheenazeem » Thu May 31, 2012 7:30 am

hello everyone,
I have just received my PR in post based on 5 years residence card issued in 2007 (yeah heyy :D). now im planning to apply for BC and my question is, can I apply for naturalization now given that I have been married for 6 years (technically obtaining PR after 5 years of marriage + 1 year wait before i can apply for BC) or does it has to be one year AFTER receiving the PR stamp on my passport?? its quite confusing i know. I have consulted with my lawyer and he has advised me to go ahead and apply now as he believes that I have completed my 6 years.
Im a non-EEA national married to an EEA national and my situation is:

came to UK as student in 2005
got married to my EEA national hubby in April 2006
received my 5 years resident card in March 2007
received PR stamp in May 2012
thanks in advance for your responses!!

Yes, you can apply now if you meet the requirements. The date on the sticker is irrelevant as PR is obtained automatically. You will need to provide proof (similar to form EEA4) that your wife has been exercising treaty rights for 5 years ending at least 1 year ago (so 05/2006-05/2011 the latest).

See two options applying for BC with PR.
