Extension or New Visa for my Wife?

Post by sibt » Tue Jun 05, 2012 3:45 pm

Hello All,

Can anyone help me in the following situation:

1. I had been in UK since March 2010 on Tier-1 General Migrant Visa. My visa got stamped for three years.
2. My Wife had also got the Dependent Visa from March 2010 till March 2013.
3. My wife was not able to travel to UK due to birth of a child during this period.
4. My wife does not intend to come to UK till April-2013.
5. Now, I am planning to go for my Extension on Dec-2012.
6. What should I do regarding re-issuance of Visa for my wife after March 2013?
7. It is intended to have my wife's visa processed outside UK
8. Would My wife be requiring a new visa or would she be requiring an extension?
9. In case of a new Visa, would it have any negative impact of not availing the previous allotted visa for three years?

An expert opinion is requested please.

You can't apply for an 'extension' of a visa from outside the UK, she would be applying for a new visa.

She will need to provide evidence that the marriage is subsisting.

Thanks Guru,
Just two more queries on the same subject?

1. Since her current visa is expiring on March-2012; should I apply after that date or Can I apply for new Visa before expiry of this date?

2. Would there be any possibility of getting the 'new visa' rejected on the grounds that she could not avail the previously allotted visa?

1. you can apply before the expiry if you wish but if she intends on travelling before that date she can (but will need to be prepared for questions as to why she hasn't travelled before).
2. She needs to provide evidence that the marriage is subsisting as already advised and to explain why she didn't travel before
