Hi All, I came to UK after 90 days of my entry clearance.

My entry clearance date : 07/01/2007
My entry : 05/05/2007

As of today, i completed 5 years. I should be eligible to apply for ILR now, right ?

Many thanks,

You will need to provide more information for a response... I.e. because the residency requirements for ILR vary based the immigration category you are applying under. Please note that the 90 days mentioned above is NOT the only consideration when determining eligibily for ILR.

Hi, Initially i came in through HSMP and then got 3 year Extension under TierI-General by 2008 Dec. Got another Tier-I General extension by 2011 Dec. Currently i completed 5 years of residency in UK from the time of my first entry.

I am aware of other eligibility. Since mr_danny mentioned above that one must have entered the UK within 90 days of initial EC grant to be eligible for ILR, I just want to make sure whether i am eligible in this criteria. Thanks.

You are eligible for ILR now if you satisfy the requirements in Immigration Rules 245CD :
http://www.ukba.homeoffice.gov.uk/polic ... es/part6a/

the 90 day (three months) rule does not apply in your case as you will be applying 5 years after your date of entry (05/05/2007). See the top of page 4 in this document:
