ILR - need clarification

Post by HKDK » Tue Jun 05, 2012 10:37 pm

Hi All,

In a 5 yrs period I was on workpermit for initial 2.5yrs and rest of the time on Tier 1 General since September 2009. I have got below few queries for SET (O):

1) For Section 3 page 9 which option should I tick

Section A
Tier 1 (General) migrant (excluding applicants applying under the terms of the
HSMP Forum Judicial Review Policy Document)

OR

Section B
Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial
Review Policy Document
Work permit holder

2) I got my Tier 1 in September 2009. So can you please confirm which section should I be filling for my ILR:

Applications for indefinite leave to remain where an applicant has had leave as a Writer, Composer or Artist, Self-employed lawyer, or as a Tier 1 (General) Migrant under the Rules in place before
6 April 2010

OR

Applications for indefinite leave to remain where previous leave as a Tier 1 (General) Migrant was
granted under the Rules in place on or after 6 April 2010

I think its first option however please advice.

3) Salary score: As I understand we need to show the previous salary of past 12 months continuous or 12 months out of 15 month period. When I applied for my Tier 1 General I was on a different salary band and now I am on different salary band. Previously I scored 30 points for my salary however now because of the revised salary I am able to score 35 points now. So is this acceptable?

4) Age score: When I applied for Tier 1 General my age was less than 31 yrs hence I got 5 points for my age, but now after 2.5 yrs I am unable to score an points for my age. So this acceptable?

Many Thanks in advance

Kind Regards
