I thought if they ask for additional docs it might be a good thing but obviously I thought wrong

For some applicants its a good thing as it gives them a chance to send more documents once requested, for others like me when they dont accept the documents theres a long wait ahead of us.

congratulation to everyone who getting thier visas
as u guys know BHC dragging us i applied 3dec 2013 and had interview 14 may 2014 and after thats they didnt response then my wife contact to MP regarding our case and BHc response him that decision has been made and our application was concluded on 5 june 2014 . and aplicant should check with his local application centre i been gerry's islambad from where i applied but they haven't got anything thing from BHC and then i told my wife to email BHC again they answer her email saying i will receive shortly notification from gerry's soon but i haven't got anything yet and my wife keep emaing them but same answer in differnt ways , i have no idea what's gonna be now what should we do , in every email they said gerry's will contact us soon but i don't understand if desicion has been made then why they haven't send yet and when thye going to send us .
please if anyone has any idea share with us

If they request more documents how do they tell you? Do they email you and send letter to Pakistani address or UK?
The UKVI sent this I'm confused

Our system shows the decision for your application has been delayed on
16/06/2014  whilst further enquiries are conducted. I was wondering whether
you received an email that contains '@fco.gov.uk'. Could you also check
your spam email box too. Once found, you will see the specific instruction
that within how many days you will need to send more original documents (or
a scanned copy) within a certain time limit. 
It is your responsibility to check your spam mail box.Your visa application
have not yet been assessed by an Entry Clearance Officer (ECO). 
Does this mean. That they HAVE requested more documents or they MAY? quote 'I was wondering' imbecile UKvi workers i am literally so frustrated I've given up.. So freaking fed up with all this BS!

Let's break this down shall we.

The UKVI rep has said that as of the 16/06/2014, it is being shown that a decision for your application has been delayed.

They are then asking if you have recieved any e-mail with '@fco.gov.uk' - reason for this is that they think there may have been one sent asking for additional documents. They are also asking for you to check your spam mailbox just to make sure. In that e-mail (should you have received one), they are notifying you of instructions to send extra documents to support your case. This is, if you have received such an e-mail asking for extra documents.

*We were asked for extra documents only when we were notified that my wife's 1st application was put on hold. Sending extra documents would have done nothing for our case because, we applied with CAT A and CAT D. We failed on CAT D as the savings handn't been in my account for 6 months prior to submitting the application.*

At the end it's rather confusing because they have mentioned that it hasn't even been seen by an ECO? Yet in the first line it says it has been delayed for further enquiries? The only time I've seen anything with 'further enquiries' is after an ECO has seen it.

People have to understand that the procedure for visa applications especially in Pakistan is time consuming. Nothing is clear, people are ill advised by some of the agents there. Further checks should not take 6 months to complete. Yet there is still no guarantee on how long they do take as everyones application is different. Some more complex then others.

For example, look at Aneesa786's case example. They apparently hadn't even seen her application until it got escalated and within a space of a few days her husband got the visa. My wife's application has been seen since last week, yet no visa and her application is pretty much straight forward, and it's the 2nd application she has made. Using the same categories.

The only advice I can give is to be patient until 6 months is up and then go from there. Contacting them every-week will not help as you may get incorrect information as you're never likely to make contact with the same UKVI rep.

EDIT: Zamzam, I see your application was submitted in December 2013. E-mail them all your details for your case, and ask them to escalate it.

Zamzam these ppl are incompetent.
That email is very contradicting.
It is clear they dont know themself what is going on.
The only clear information In that email is that your application was looked at and delayed on the 16/06/14 for further enquiries.
After that whoever dealt with your email is just 'wondering' if you were sent an email requesting further documents, how unprofessional is that !!

I had an email from them last week saying my application is currently being assessed by an ECO. How long its been under assessment only 'god knows'.
However they asked for some information to escalate my case. Ii sent the information one week later, in the start of my 23rd working week. This morning I received a lengthy email highlighting their service standards .. what a load of 'crap', tbey requested this information to escalate my case.
Anyway as we are stuck under this incompetent system we have no choice but to wait. However for some of us at the end of the so called service standards and those who have already completed their 24 weeks we still have to keep chasing our applications so its not just sitting on a shelf gathering dust.

Zamzam check your spam and email them back.

Firstly, I'm so happy for those who received their visa. This is so destructive to our lives, I understand directly.

I've applied from Mirpur 12/03/2014, and still not heard anything yet. I asked UKVI and they said, it is under processing. I've been waiting since June 2012 (marriage) for this. :cry:

But I've made a mistake I think... Please help me with a few questions nagging me...

1. If you work through an agency at a place (same job) but then become permanent, can you count this for the 6 month period of wage data?

2. What if you are ill in that time, for say, 3 weeks... do they allow 3 weeks additional to make up?

3. If you meet the financial requirement but have selected the wrong Category, can you change this after? Will they automatically refuse such an application or review it under a different Category that it can meet too?

4. I had a business as well as my full-time employment... I included my business details and earnings, but not thoroughly (as per the documentation requested). Hence I just applied using my FT work salary without adding business details. Can I send in more details of my business to BHC since it has now done 2 full tax years, with its full accounts data?
I mean, will they even consider this if the salary requirement doesn't meet scrutiny?

Without the business I should be at 20k but with it, far over if they checked my real HMRC income.

Thanks everyone... honestly, it has been a long and hard struggle. People have relatives etc in Pakistan, I had no one, and am alone, and my wife and her family are the poorest of poor, not relatives. Earthquake torn. Thus I have had to support them all, and provide education, housing, food, work and everything, and to travel every 3 months to Kashmir having a daughter there. It has wrecked me financially, physically and mentally - more so my wife and girl.

1. Depends on which category you are applying with. Category A = Working with same employer for 6 months. You must submit 6 months payslips/bank-statements. It would help if it was a permanent position more so then temporary position.

2. If you are ill, and you are paid sick-pay then it's great. Although, if you are sick and do not receive pay for this (may be paid weekly, may not get a payslip) they could count this as you not being in employment. They have done this with some cases before. If you are paid monthly (could be hourly), your hours may show less then your basic hours, so they may conclude you were not working.

3. Checking the category you are applying with and ensuring all documentation which applies to that category is vital. You cannot change category once you have submitted your documentation.

4. If you applied using self-employment and didn't have documentation which is now available, but wasn't available at the time, you can submit this if they ASK you for it. Please do take note, that any documentation should be dated and of your circumstances prior/at the time of application. Anything after will not be counted.

Yep Cat A... but if first through agency (temporary) for 2 months at the same job/place, but then you become permanent (taken on by the firm for the last 4 months)... can you submit those wage slips?

Same job, site, pay...

Alhamdulillah, I was very lucky. 520 agency workers fighting for a permanent contract, only 3 Asian workers there. I was 1 of 12 to get the permanent contract and the only Asian at the company since.

Who paid you for the 2 months previously? The agency or the employer? If employer then you can get 6 months payslips and submit.

If it was the agency you will have to work a total of 6 months with your employer and then submit.

After sending them documents if they accept your documents it is likely that you will get RFC message. If they havent, you wont hear from them. What i did was about after 2 months of submitting further documents my husband emailed them to ask whether they accepted documents or not and there response was that they cannot conclude our case until the legal court income threshold decision is known.

I'm ready for a rejection then. :|

Funniest case ever. I genuinely met the income requirement (well over), did additional part-time work and had extra biz with much more income... and very specific humanitarian circumstances, but, the mitigating circumstances at the time meant I applied in this way. A way that could mean automatic case rejection without any details being checked.

I save £1k a month, have an additional £7k in bank saved, £3k in shares (all within the past 8 months), as well as £13k spent on going Kashmir 4 times this year with receipts.

1.5 months after applying, I stopped additional ad-hoc part-time work, and 2 months after, took a drop in position and salary in my FT work, so now re-applying with new wage data would also be out of the question. In Nov '13 and again in Mar '14, I lost a job offer due to needing to travel for my wife/daughter that paid above the financial requirement.

People think THEY have it hard and unlucky.

Dont give up, i applied twice n got refused. Now 3rd time applying in shaa Allah.
Just wait it out n try again.


Trust me, i'm one of those people that is literually going through hell. Just re-read requirements, and get advice fro om people on here.

I applied online on 19th May 2014 and submitted my application along with supporting documents in Islamabad on 27th May 2014. I received the message on the same day from VFS that my application has been sent to decision making Centre, apart from that I haven't heard anything yet.

Hi. My wife got the following email from BHC.

On 5 July 2013, the High Court in the UK handed down its judgment in a Judicial Review of the minimum income threshold for spouses/partners and children applying in the family route. Having reviewed the judgment, the UK Home Secretary has decided to pursue an appeal to the Court of Appeal.
The Home Office has therefore temporarily paused decision-making on some spouse/partner and child settlement visa and leave to remain applications. More information about this hold on decisions is set out on our website.
Your application for entry clearance under paragraph E-ECP.3.3 of Appendix FM to the Immigration Rules has been considered. Your application falls to be refused solely because you do not meet the income threshold requirement under Appendix FM and/or the related evidential requirements under Appendix FM-SE.
Your sponsor states that he earns an annual rental income of £xx,xxx.xx from his property, however you have not submitted the specified documents in order to verify this statement:
(i) Confirmation that the person or the person and their partner jointly own the property for which the rental income is received, through:
(1) A copy of the title deeds of the property or of the title register from the Land Registry (or overseas equivalent); or (2) A mortgage statement.
(ii) Personal bank statements for the 12-month period prior to the date of application showing the rental income was paid into an account in the name of the person or of the person and their partner jointly.
(iii) A rental agreement or contract.
These documents are specified in Immigration Rules in Appendix FM-SE and must be provided. You have not submitted all of the required documentation to demonstrate your sponsor’s income is as claimed.
A decision on your application has therefore been put on hold until the Courts have decided the outcome of the Secretary of State’s appeal in a legal challenge to the income threshold requirement. The documents submitted to do with the rental income were the title deed for the property, the tenancy agreement with my tenant and bank statements. My tenant wanted to pay the rent in cash and hence the rental income was not shown going into the bank.

I think this is why they rejected the income level.

We did submit the tenant’s housing benefit letter from the Council showing that the rent was being paid by the Council as housing benefit for my tenant.

What documents can I send now to prove that I am receiving the rent?

Should I send my tenant’s bank statements showing the tenant receiving the housing benefit from the Council and an affidavit from my tenant that he wanted to pay the rent by cash and that he has been paying rent?

The tenancy started long before I got married and I have owned the house since several years before I got married.

Is it also worth seeing my MP together with my tenant and get the MP to write a letter that the rental income is genuine.

I cannot show the rental income being paid into the bank but how else can I prove to the ECO that the rental income is genuine?

(iii) A rental agreement or contract.
These documents are specified in Immigration Rules in Appendix FM-SE and must be provided. You have not submitted all of the required documentation to demonstrate your sponsor’s income is as claimed.

Sorry to hear your case has been put on hold.
You need prove you received the rental income from your tenant. That can only be proved if it goes directly into your bank account or if you received cash, then you deposited the cash into your bank account each month around the same time.
Your title deeds prove you own the property and tenancy agreement proves you have tenants but there is nothing you have shown that you receive the rent. Sending your tenants bank statements will only prove your tenant was receiving the housing benefit and withdrawing it from his/her account. There is still nothing to show that you were getting that rent from him/her.
Did you have any rent/receipt book ?? Surely on receiving the rent from your tenant you were issuing some type of receipt or signing the rental book.

Aswell as title deeds to property is it also important to submit a mortgage statement?

Hi. We did submit the title deeds and there is no mortgage. And we submitted the tenancy agreement. I don't think they are saying that they did not receive the title deeds etc but they have just copied all the requirments.

Isn't it enough proof that the council are paying the rent to my tenant and i can get my tennat to swear an affidavit that he has been paying rent to me? How else can we prove?

I explained in my letter to the ECO at the time of the application that the rent is being paid in cash.

I want to submit as much as evidence as possible within the 3 weeks they have given us.
