Tier 1 (General) extension due in November 2012

Post by confused00 » Tue Jun 19, 2012 12:41 pm

Hi all,

I'd like some clarification regarding my Tier 1 General extn due in Nov 2012. I have 576 days of continous absence for personal reasons and another 141 days of continous absence for personal reasons during my current leave.
Would it be an issue to apply for Tier 1 Gen extn? Should i give an explanation in my supporting document or am i attracting unwanted attention from the IO?

Any support is much appreciated!
Thanks.

Absences from UK have no relevance to leave to remain (read extension) application as a PBS migrant.

Thank you for the immediate reply. crystal clear.

However, officer at the airport questioned me about the long period of absence and suggested that i generally should not be allowed to enter.

Where can i find more relevant information for this issue in the UKBA guidelines? (Sorry for the trouble!)

You cannot expect a non-requirement or imaginary requirement to be documented.

Next time if an IO comments on your absence, stand firm and ask him to show you the policy guidance that suggests that you can be refused entry because of excess absences.

I was going through Appendix A -Attributes of the Immigration rules in the UKBA website, and i cannot understand this particular clause. My understanding of legal terms is fairly basic.

http://www.ukba.homeoffice.gov.uk/polic ... appendixa/

"Age: notes
33. if the applicant was first granted leave in the categories of Highly Skilled Migrant, Writer, Composer or Artist, Self-employed Lawyer or Tier 1 (General) Migrant and has not been granted leave in any category other than those listed here since the first grant of leave, points will be awarded based on the applicant's age at the date of the application for that first grant of leave. if the applicant has been granted leave since his first grant of leave in a category not listed in this paragraph, points will be awarded based on his age at the date of application for a grant of leave in a category listed in this paragraph where leave has not been granted in any category not listed in this paragraph between that grant of leave and the current application."

Thank you in advance for your valuable time and support.

Perhaps reading this topic will help you decipher the "legal lingo" in the quoted paragraph.
