SET (O) APPLICATION questtion on 6.1 & 6.2

Post by nottinghill » Wed Jun 20, 2012 8:55 am

SET (O) Form QUESTION
Could someone please help me on the following
In the Set O form in page 12 under 6.1
6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.?

I actually came to UK 2004 but this application based on my last 5 years. So do i need to mentioned the first i entered in i e 2004 or just before i got my HSMP i was on leave and came back Oct 2006. My 5 years will be from Sep 2007-2012.

I am confused with First enter the UK “phrase “

Second question under
6.2 Since then have you had any absences from the UK? If yes, give the dates you left and returned to the UK and the reason for the absence in the spaces below. List all absences however short and in date order. If you need more space, continue on a separate sheet and enclose it with your application

Do i need to put any absences before I was granted HSMP

Many thanks for all your reply in advance

6.1) Before answering this, did you enter the UK on your HSMP visa in Oct 2006? I.e. was your HSMP visa in your passport stamped with this entry date?
6.2) You only need to list the absences during the (HSMP) 5 year residency period as an economic migrant.

Hi CDP

Well you also need to mentioned the entry and exits dates after the year 2007 as your application is based on last 5 years.

For the Co-hab docs try to take a combination of 3 or 4 different documents eg your wife DVLA if she have one any bills under her name, joint bank account statement if you have one or your wife bank account statement I think that should be suffice for the Co-hab docs.

For the employer letter try the format from the sticky and just address it to the UKBA and the address of the PEO which ever PEO you're going to.

Please do kindly share your PEO experience with us on the forum.

Good luck for your ILR.

6.1) I have to say, I don't know the correct answer to this for your particular circumstances. The form does clearly ask for the date of entry (& not the date your switched visa category though that would be more appropriate here) , so all I can see is for you to enter the date you entered the UK prior to switching to HSMP. The question doesn't appear to cater for those who switch in-country, but rather towards the majority who enter the UK in an economic migrant visa category and then go on to apply for ILR.

Some may see it more appropriate to enter the date of switching to HSMP. But personally I'd stick with the date of entry (for which you would have a stamp in your passport) and then may be explain in a covering letter.

For 6.2) my answer remains the same as before. You only need to list the absences during the (HSMP+Tier 1 General) 5 year residency period as an economic migrant.
