Hello Guys.. My friend came into the UK under the name of someones passport. But now He is legally married to a EEA citizen right here under his own name( with his own passport without visa). Now They are planning to apply for Residence Card, could this be a problem as he does not have any legal statues here ?? I mean since he does not enter here with visa, can this be a problem for his application?? Does he has to take a lawyer?? thanks guys

the wife is legally working here for the past 4 years now constantly, but now we don't know if he is going to be granted the residence as he does not have any uk visa on his passport(came in with someone passport). He is staying with the wife and they do have prove of address and everything.. do u think he need a lawyer??

There hasn't been sufficient information given on this matter for anyone to be able to say with certainty if he needs legal assistance.

Being illegal itself should not be an issue once they are married.

However, the HO might question his current identity - who says he is now using his true identity?

I agree. The fact that he is now married to an EU national will not erase a criminal offence. They could still take action on this but he won't be removed

Well concerning concerning his identity, he has a valid passport from his embassy.

guys, these questions are totally irrelevant. Just give him advive if you can, and stop playing UKBA. Stop judging people on this forum.

Regarding his case, once he is married to an EU national, his case is settled, they cant do nothing to him, provided that it is not a marriage of convinience!

Let him go ahead and apply for residence card since his wife is working.

I certainly have not judged anyone, nor have I even seen anyone “play UKBA” (even if I am not sure exactly what you mean).

Nobody here has or could or should prevent the OP from going ahead and applying for an RC.

But if you want comments and useful observations from other participants in this form, then it is important to be clear. Some of the things the OP has written are ambiguous . And so I asked my question.
