what if i file a fresh application and do not withdraw the appeal what happens or this situation is not possible at all

The law does not allow you to do so (3C(3)).

Hello everyone

As my tier 1 extension is refused by UKBA

i had shown 95 points in total for first time i got tier 1 application if i file a fresh application do i need to show the same amount of point do let me know

You do not need to claim the same number of points as your first application. What you need to do is, score the points required to qualify based on the Tier 1 General guidelines.

Hello everyone

Can anyone let me know how time will it take for a tier 1 extension appeal to complete and determine the outcome

i filed the appeal on 15th June 2012

now if the appeal process goes beyond 3 months and crosses October 1st then the will be new rules for fresh application starting October 1st
in case i loose the appeal i might be in trouble for fresh application

Can anyone comment on this

As I understand, you'll have 28 days from the date on the refusal letter to file a fresh application.

Hello guys

I want to know one thing after the appeal hearing if case does not go in my favour & that i had to go for a fresh application can i not get a premium same day service my lawyer says i cannot get a same day premium service because i will be a overstayer and the UKBA at that time will treat my application as overstayer and might probably take their permium service charge and reject my application

is that true

let me know your feedback

also one more thing my tier 1 visa expired on 15 th may 2012
if i go for fresh application also do i can show my earnings for the month of June,July or i need to show my earning only till 15th of May

brother.I applied PEO. after 12 weeks refused tier 1 extension. salary+net profit of my own limited company. not accepting limited company net profits.

only counting salary+ dividends not accepting the money remaining in business account. saying as the money is not transferred into my personal account from my business account it will not be counted as my earnings.
