Dependant Visa Denied (Canadian)

Hello,

I am wondering if anyone can provide some insight. I am a Canadian, married to my British husband. In April of this year my settlement visa was approved in just two weeks time. Since then I moved to England, and within the month of being there, my 15 year old daughter decided she wanted to join us asap, for personal reasons. We flew her over with the impression we could apply for her settlement visa from within the UK. We quickly found out that that wasn't an option and she would have to apply from Canada. She was refused entry for her visit - as she was entering with only a Canadian passport with the intent to settle there - we thought she could stay up to 6 months and decide if she liked it there enough for us to get her visa. We didn't do this intentionally. Anyway UKBA arranged for my daughter to fly back to Canada three days after she was denied entry and detained for 8.5 hours, finger prints and mug shots were take, her suitcase emptied and all personal effects gone through, she wasn't even allowed to speak with my husband or I during this time. Anyway, my daughter flew back and is currently in Canada.

Since then, I returned to Canada also to take care of my daughters visa application. We submitted everything, did biometrics and had a letter of consent from her father who resides in Canada - agreeing to this move to the UK. Just today I got a call from the British Consulate in NY with a couple questions regarding our application. Then I later received an email advising that my daughters application was denied. I feel as though I am getting the total run around here. At this point I am not sure on what basis the visa was denied, but I am completely dumb founded as to why my daughter doesnt have the right to live with me in the UK. She isn't of age to live on her own and support herself. I feel the decision may be based on the fact that I have also had the local UK MP involved, who submitted a complaint to the UKBA on how my daughter was treated upon her arrival, when she was detained/deported.

Anyway I do intend to appeal the decision, but in the meantime, I am wondering what happens with the monies paid at this point? Do we get the application fees returned to us? I cant imagine having to pay the fee again, only for them to mess us about once again.

As well, how quickly can we appeal if we have the right to?
