Appeal sent to First tier tribunal on the 22 of august.
still waiting for the rest.

No dear no news from HO but I contacted my solicitor. He advised me to wait 2 more weeks if nothing comes then we will write them. Hopefully you get your reply soon as well. Finger cross.

Hi horizon thanks for your reply today is 12th September .hopefully next week the court send me my decesion with good news

Hi guys I received today my appeal decesion the judge allowed my appeal and also write in letter the ukba can appeal against our decision to uper tribunal with 5 working days thanks for every one and good luck who still waiting.

No I haven't heard anything from HO. To be honest Zahirsona ..now I am relaxed. I don't want to give pressure to HO and want to wait patiently because it takes 8 weeks to complete all process. But if we wont hear anything by the end of this month then i will tell my solicitor to write them an email. Do pray that your case will go smoothly as well and for everyone.

Thanks horizon I ask to my solicitor he say wait one week then we send passport to HO and the judge refund me the court fee as well.
Horizon the UKBA send u a letter for request original passport

Actually they(HO) already have my passport with them which is expired now. I don't know whether they would request me to sent them new passport or will issue me RC on A4 paper.

Hi all,
My timeline:
16th April submitted application
13th June - COA
18th September Refusal
Appeal received by 1st-tier tribunal on 28th September (with track mail)

So my reason was being refused:
Not enough evidence of my husband is exercising his treaty right as self-employment. So we resubmitted all the bank statements, most updated account letters and PO from his agents.
Also all the NI contribution letters plus the payment made via online payment shown in the bank statement.

My questions:
1) My husband was away for few months to work at Australia for a new projects, there was a gap between some months - do you think I need to further explain?
2) We submitted for paper hearing, do you think it reduces our chance of appeal?
3) I spoke to an online legal service, they advise me when I receive the appeal notification, I can change to oral hearing, should I wait for that or should I call the office tomorrow to change it to oral hearing ASAP?
4) Do you think it's better to have a legal representative? We are genuine and I have just offered a job, I don't want to separate with my husband.
5) How long does it take to wait for the appeal notification?

Many thanks - I'm in deep fear and cannot sleep. Yesterday was the first time I burst in tears as I was so tense and nervous and my head was spinning.

Please help.

And why it took so long to refuse my application. It was almost the deadline of 6 months. Do you think they intentionally to trip me?

eea application sent 15th November 2011
application received 16th November 2011
COA received 11th of december
application refuse 2nd of feb
appeal sent 6th of feb
appeal date 05 july
appeal adjourned due to my wife delivery date
new appeal date set to 7th of august
appeal heard on 7th of august and allow
judge decision 13th of august
RC receive 05 October but was issue 24th of sept

my prayers to those who just started the journey and to those who ar nearly there..

Hi this is my timeline....

EEA2 application submitted: 31 Jan. 2012
Application returned : end of MArch 2012 (UKBA needs more proof of durable relationship and tax statement of my self employed partner, I thought my sons' birth certificate is proof that we're in a durable relationship as we're not married yet)

EEA2 Resubmitted: 13 July 2012 - complete with all tax statements, joint account letter and bank statements
HO Received: 16 July
COA Received: 12 Oct 2012... sent 9 Oct 2012


*** I am submitting as an unmarried partner with a 9 month old son... living together with my self employed EU partner... I organized my application myself... Really nervous....

So your actual appeal process started from 7 August ?
Did you ring or email them once your appeal allowed ?
My Appeal allowed and judgment made on 24 August, still waiting for RC.

my appeal was heard on the 7th of august and was allowed on 13th of august, i dont ring or email, the RC was issue on the 24th of September and i recieve it 5th of october

Matma thanks for information. Trust me this waiting time is putting me in frustration. Lots of things are in pending because of RC. Do you think that I should ring them or email them? or should i just wait like that ?

i think u will receive ur RC soon, u can ring them if u want and u can contact ur lawyer to write them too, i think it depend on the way the judge allow ur case, the judge wrote on the decision letter that HO should issue me RC as soon as possible cos they dont do a gud job on my case and is over six month. and with that my lawyer wrote them too a letter on the day he send the decision letter. hope u get it soon gud luck

dis the adress on my letter sent with my RC

avnt send them eamil before but dis is their address and email writing on my letter. hope this help

My case was straight forward. We didn't provide my wife's self employment bank statements showing her regular income and invoices because at the time of application she just started to work. However Judge mentioned that HO could ask for further documents which they didn't or could verify things as they have an access to HM revenue etc. But he also said that if these documents could provide at the time of application made or during the process of application then there was no need of this appeal.
I don't know whether I have got an upper hand. I am just trying to wait until end of this month. Then I will ring or email them definitely.

i see u have upper hand in ur case, all you need is patient u can phone or email when u ve wait enough, and some times home office issue RC and they leave it sitting in their office for long before they post it, dis usually happen to many people
