I want to ask you. In 2015 after 10 months awaiting for EEA2 Residence Card for my wife -non EU, Home Office refused , the reason is fact that I have dual citizenship. I am Polish and from 2014 British.
We appeal to the First Tier Tribunal and still waiting for the trial.In October this year will be 2 years of awaiting for EEA2 , so we don't want to apply for visa for my wife as a British member family . Home Office gave us a lot of stress. My wife had a miscarriage. We scare to travel outside UK to see our family.What we can expect from First Tier Tribunal?do we have a chance for EEA2 Residence Card?We appealed by human rights.
Did anyone had similar situation?

A quick update :
My wife sent an email to : NWEUROCOARequests@homeoffice.gsi.gov.uk
In ordee to ask for a new COA letter since hers has expired afyer we appealed, and she received the following instant email reply :

Thank you for you e-mail requesting a duplicate Certificate of Application (CoA).

Please note this in-box is only for applications made under the Immigration (European Economic Area) Regulations.

Duplicate CoAs will be issued where either;

• your CoA has expired and your application is still outstanding
or
• your application has been refused but you are pursuing an appeal against that refusal decision.

If appropriate a duplicate CoA will be issued with a refreshed date, but, if the original CoA did not state that you have a right to work, the replacement will take the same approach

Duplicate CoAs will be sent by post within 3 working days of the receipt of your e-mail and you will not receive a further electronic notification other than this acknowledgement.

E-mails and other general enquiries will not be responded. Further information can be found on the website: www.gov.uk/uk-visas-immigration or by telephoning the customer contact centre on 0300 123 2241


And we did receive the letter 4 days afterwards!

Yes I did. Didnt post it here because the refusal was once again ridiculous .
They had to lie to refuse me :) As all documentary evidence was against them.

refused with right of appeal: 03/2015
appleal logged : 04/2015
go married: 04/15
send second applicaton eea fm: 09/2015
called for interview for second application at liverpool: 12/2015
hearing of 1st application EEA unmarried partne: 01/2016
appeal allowed form me and my wife jointly : 01/2016
i dont understand this wording of JUDG FTT as given below:
1- EEA NNATION SPPOUSE APPELANT , HER APPEAL IS ALLOWED
2-IN RELATION TO APPEALLANT 2(PAKISTANI), AS APPEAL RELATES TO UNMARRIED PARTNER(eea efm) APPLICATION, i REMIT APPELANT CASE TO RESPONDANT FOR RECONSIDERATION UNDER REGULATION 17, TAKING INTO ACCOUNT MY FINDINS , I HAVE MADE.
3-NO ANONIMITY DIRECTION IS MADE.

furthermore: judge has given her finding in my favour.
later i contacted to presenting office, he said we are going to chellege decision of judge and we will refund you fees. he also saind you appeal is not fully allowed.
i very confused how much chances i have to get my RC.
can HO re-refuse my my visa .
kindly anybody who experienced already same case, kindly advise me,

Appeal allowed 6 months ago still no response I complaint on enail address they said will get response in 20 working days still no reasons yet ? Any one had experience like this....

They also said that our messages to each other were platonic and about her University life and our friends. They said it was loving and caring but not in a sexual way.

On the basis of that they claimed we are in a sham marriage ... Its ridiculous but what can we do.

Hi Alex you should appeal against the decision try to get as much evidence you can like phone bills text message bills bank statement and witness statement from your and wife friends
I'm 100% sure you will win I had similar situation and I won my appeal

My wife was on holidays when Ho visit my home they refuse saying its sham marriage which was not so I appeal add all evidence like bank statement phone bills text message tenancy agreement witness statement from friends family went on hearing appeal allowed Ho don't like to give visa to non eea you have to fight.

Which region of the UK are you based. LONDON is of particular concern, but people in Northern Ireland and North of England gets quicker dates.

Finally I got a reply after 1 month of my complaint.

Let me copy paste there reply


i have fully reviewed your complaint and I am satisfied that based on my findings, which I have set out below, your complaint is substantiated.

I have contacted the Post-Decision Casework team, on your behalf, who have apologised for the delay in implementing the appeal determination, on your case. They have advised that this is due to a technical issue, regarding the printing of the necessary vignette, but are confident of concluding your case within the next four weeks.

I hope this answers your concerns.

It will be 7 months after 12 days Still waiting...
