Please update your signature as well with your timeline so we don't need to ask on and on again what is the timeline and reasons why the EEA was refused in the first place.

I was about the send the letters the day that the postman showed up to my door with the passport. I planned to send 4 letters to these addresses. Note : Tried to contact HO for updates but the agent always said that it was still with the case worker and they have 6 months starting from my last application to deal with my case…
RC Refusal : 13/08 reason was : that I didn’t send the new employment document for my husband, they called his former employer that told them that he left the company. The thing is when we sent back the application the second time we thaught that they would consider the application as it was in January 2015…. So the HO deducted in March that my hubby wasn’t exercing his treaty rights anymore…..
Application for reconsideration : 14/08 I told the case worker that we made a mistake by not sending the new documents, we put the new contract of employment, company details and contacts and said that we we’re sorry that we didn’t send those documents even if we had to and wants him to reconsider the case with the new evidence.
Reconsideration refusal :19/08 the case worker wrote back saying that we signed the application documents and we were supposed to know that we had to send new relevant documents if any changes occured by the time they deal with my application. So he asked us to fill an appeal or re-apply with the risk that they might consider me as an over-stayed (why I don’t know)….
Appeal filled : 20/08 with all the documents and a cover letter from my husband explaining what happened with the application.
Tribunal letter received : 01/09 letting us know that we have until the end of the month if we wanted to send new relevant documents for the appeal
HO letter received : 29/09 letting us know that they sent all the documents to the Tribunal and gave me a copy of everything from the application, the letter from my husband former employer stating that he wasn’t working there anymore to the refusal of reconsideration
Note : every month I called twice to ask about when I will get a hearing that the answer was : the tribunal has up to 12 months to give you a date or the hearing date will be 12 months after the month you first filled your appeal….As I choose the paper route , I will never received a letter or a call in regards to an hearing date. The only letter that I will get was the final decision.

COA : 22/01 with right to work
Note: My husband wrote in March to the tribunal because he changed work (he's self-employed), he knows that the documents might no be considered because the delay to send new documents was over in September, but in good faith and to avoid any problems in the future (I.E the tribunal calling his former employer and he wasn't working there anymore.... ) he decided to let the Tribunal know about that change. He provided all the relevant documents (contracts, extensions, company details and managers contacts as work phone number, emails, etc....) and also let the tribunal know that I was expecting and that I didn't travel to see my family for more than 1 year and that he really wanted the judge to consider our appeal ASAP so that we can have the RC before my due date (september), travel and prepare for the baby with our families.
Decision received : 07/05 (wasn’t a signed for letter) Appeal allowed by the First Tier Tribunal on 21th April, decision promulgated 5th of May
Note : I called the tribunal to ask what’s next and they told me that the HO has 1 month to challenge the decision and then after that up to 6 months to issue my RC. I decided to write to the HO on the 3rd of June to request my RC ASAP as the 1 month delay to challenge the decision was almost over. The next day my passport was finally in my hands with the RC on it.
RC Issue date : 21/05/2016
RC received: 04/06/2016

@shaaki.fabi thanx for the update on your case,can you please give a timescale since u first lodged your appeal.On the other hand it's possible u let ur application to be dealt with by the HO and continue with you appeal as u stand a better chance with it,but as u just got ur hearing date I reckon u will get ur decision more quicker from the tribunal than the HO.good luckshaaki.fabi wrote:Hi i sent my appeal last october but since then there no reply from court, in the mean time i made a new application £65 sent all documents etc, after two now i received a reply from court that my appeal have been accepted and my hearing date is on september,

@shaaki.fabi thanx for the quick reply,i suppose it's too late to suggest that u didn't need to make a new application when u got married u only needed to inform the HO with change of circumstances and send off your marriage certificate while your initial application was under consideration.Anyway if u don't need ur documents from the HO for your appeal,i would suggest don't put your eggs in one basket and good luck mate.shaaki.fabi wrote:first EEA2 file without marriage : february 2015

sent appeal in SEPTEMBER 2015
till that day didnt hear from court for 9 months,
sent new file EEA2 in APRIL 2016 because there was no sign of appeal, i thought may be they forgot about me
then got a reply from court in JUNE 2016
now hearing date is 24 september 2016.
@Sziszko hi mate Thanx for sharing ur case with this forum.I would like to suggest that just be ready for random questions from HOPO about your relationship with ur partner.Would you please provide the dates since you first lodged your appeal and when you got your hearing date from the tribunal so that other members have an insight how long they gotta wait for a hearing date.thanx and good luck on ur hearing.Sziszko wrote:Hi all. @hamodziakto hi apparently it takes 4weeks the decision from the tribunal to reach the visa section that dealt with ur initial application and more 8weeks to issue the visa/RC if they don't challenge the tribunal's decision,it might be quicker like one of the members on here she got her RC within a month of receiving her decision letter from the tribunal.can u please give a timescale for ur appeal.good luck matehamodziakto wrote:I won my appeal around 2 weeks ago get a letter from the court.
