Reg applying Tier 1 Extension before 70 Days.Pl help

Hi All,
I am planning to apply for my Tier 1 Extension through PEO office around Oct 15 2012 and my Visa is due on Dec 21 2012. Would my extension visa would be given from Dec 21 2012 to Dec 21 2015 or from Oct 16 2012 to oct 16 2015 ?

Applying 70 days before would have any effect when I am going for ILR. Please help.

For your further info I came exactly on the same day to UK when my initial Tier 1 visa started ( on 21 Dec 2010).I am well aware that in UKBA website they have mentioned to apply before 4 weeks. As I am planning to go to India during christmas holidays I am planning to apply bit early.

Apologies if this question is answered previously to many people. I would like to know current situation, so that I could avoid a mess while applying at ILR.

UKBA guidelines says, it will be from day of approval. So it should be from oct 16th, but we have seen sometimes case worker gives from date of expiry.

yes, if you will run short of 5 year. If you are going for PEO why you going 70 days earlier. You can go 20 days earlier.

No one can give you a definitive answer to this. But the liklihood is that you will fall short of the 5 year residency period if you make a in-person PEO application 70 days before visa expiry. Generally the UKBA advise that you apply 1 month before your current leave expires, and in this case they renew your visa from the date of expiry, but if applying earlier the chances are that the extension will be from the date of application. We encourage you to make your application at least 1 month before your current permission to stay expires. However, if you apply significantly more than 1 month before your permission to stay expires, and you want to apply for settlement later, you may not have accumulated enough total permission to stay. This is because your new permission to stay will begin on the date when we make the decision, not the date when your current permission expires.

Thanks a lot for your views.

I am planning to visit to India and more over I am IT contractor. My current contract is ending around October. For applying for new job most of the agents ask for atleast 6 months of visa. I thought of applying around october to play it safe. I have seen some threads in the forum who applied before three months and got the visa from expiry.

I am confused right now :(

Seniors, Please share your opinion whether to go by october or not for Visa. I may need to book visa peo appointment soon based on your views.

Hi mate, no one here will be able to say for sure that you will get your extension from your expiry date. As it totally depends on the caseworker. I have read in few PEO experiences that if you have a good reason to apply early then case worker do give you the grace. However, as per the guidelines, if your extension application is submitted more than a month in advance, they will give you the extension leave from the application date.

So, if you do want to submit your application in October then make sure you have a good covering letter which justifies your early application.

Also, regarding the PEO appointment, you won't be able to book for October any time soon as currently you can only book it till 15th of August. So you got time. Think about the consequences.

Thanks for your reply longshift. I will be careful in booking for VISA. If you know some one got a visa from the date applied before two months please pass on the details. My friend who applied 50 days before visa expiry got visa extension from expiry rather date applied. He applied last week in croydon PEO.

I am an IT contractor and I own a registered company in UK. I am the director and 100 % share owner. I take Salary + Dividends. My Accountant confirmed I should be treated as Employed even though I am a director.My accountant says I Pay class 1 NIC Insurance to HMRC. Accountant agrees to give all the salary + dividend break ups with Payee/NIC/VAT Paid during the assessment period for Tier 1 extension.

What should I mention in HMRC application as employed or self employed ? Does it makes any problem while applying for extension.

I am planning to go with following documents .Seniors Please let me know if I am missing some documents
  • 2 photographs 
    1 Form Tier 1 General Extn Application
    12 Months Bank Statements  - Personal and Savings
    12 Months Pay slips signed by my accountant
    Company Certificate (From Companies House) 
    Share Certificate (100% shareholder) 
    Company tax return filed at companies house last year end (Apr 2012)
    Business Insurance 
    Client Contracts for the assessment period
    Invoices 
    1 Year Business Statement 
    Income Certificate (from Accountant) with Salary+Dividend breakups month by month with NIC 1 Insurance Paid so far in the period
    Profit/Loss Statement last financial year (from Accountant) 
    Dividend Voucher

    So In other words I am employed or self employed when I am filling the Tier 1 extension application?

    Looks Contradicting to me in the link you pointed.

    Under Part 6A of these Rules, "Self-Employed" means an applicant is registered as self-employed with HM Revenue & Customs, or is employed by a company of which the applicant is a controlling shareholder.

    I fall under the later category who takes salary and dividends employed as a director and paying Class 1 NIC.
