ILR situation wife of PBS Tier 4 student,

ILR situation wife of PBS Tier 4 student,

Hi All,
Im going to apply ILR based on 10 year long resident as PBS TIER 4 student this september. My wife is here in Uk as my dependant for 4.5 years and last 2 years of it is as for PBS dependant . Our current leave will both finish on May 2013. as far as I know we cant apply ILR same time this september, so my wife has to be converted to FLR(M) first or can she straight apply for ILR after I get ILR (hopely)? cos my wife has enoughish time until my settlement application is decided.

another thing, is her qualifying period for settlement 2 or 5 years? obviously she became PBS dependant before 09/07/2012. I mean is old rule apply for her?

Hi thanks for your answer. below is your first post on another thread. And you must have been PBS dependant before your husband got his ILR. But now your husband's status is ILR rather than PBS student which means your are presumably no longer of PBS students dependant actually. dont you need to change your status now?

in my case my wife has dependant leave until May of 2013, so can I apply my ILR on my own and after getting the decision, obviously before her leave finish, can she apply FLR or ILR whichever is correct?

in your family experience it seems your husband applied ILR on his own and now its is your turn. I thought we have to apply same time even my wife (I thought she has to change her status when I change mine) has a plenty of time of PBS dependant,

(My husband has ILR(long residence) & I'm still in PBS (tier 4) dependent, I will complete my 2 years PBS dependent on 03/2013 & I have visa until 04/2014 & no imminent travel. )
