EEA Family Permit with "Adverse immigration history&quo

Dear forum members,

I applied for protection in UK at the age of 15 under a different name. I was given permission to stay until the age of 18 and then given a ticket to return. However, I stayed a few more years and then decided to return to home country with a passport issued under my real name.

Now I have gotten married to an EEA national and we are planning to try to establish ourselves in the UK. The advantage being the language rather than the economy :)

My partner has left for UK a few days ago and I plan to apply for a Family Permit in about a month.

What are my chances of getting this permit with no stress as the UK Authorities took fingerprints and photos when I reached 18, just before they wanted me to return.

When I apply for the FP, I will use my real name, however, I will show up on record as already being in UK under a different name, James Bond style.

You think I should come clean and tell them the whole story or tell only if asked. Can I be refused under any circumstances?

Please advise and ask if you need further info.

P.S. It's not a marriage of convenience (work in an EU country made getting together possible). Also these occurrences many years apart.

2- Are you in EU country now? if yes under what RC?
3- did you leave the UK with enforcement or no?
4- any other conviction in the Uk other then Immigration?"


Hello,

I married recently in my country.

I do not have a RC in a EU country but have had in the past. I dont know about enforcement but they gave me a ticket and said go to the airport. I didnt but I left with own expenses/wish a few years after. Dont have any convictions, I was studying.

Isnt it true that even if ECO refuses, I can get the EEA Permit at the border if I am travelling with partner?

Ive heard this is possible.

This is true but for that you will need to get to the border and if you are a visa national you won't be able to board the flight. If you are not a visa national, then the Family Permit is not required at the first place.

Im a visa national but only for the UK as I can travel in the Schengen zone, benefiting from the visa liberalization that was given to certain countries at the edge of EU.

Do you suggest I skip the Embassy application altogether?

The choice is yours. See No visa but still want to travel.

It's less likely to get a refusal at the border. The only issue might be a proof of your true identity (who says that now you are who you say you are).

But I do have a national passport which I have used throughout the Schengen zone in last few years.

And I dont really need to discuss my past in the UK at the border I think.

My issue is if the border police will let me through as they might be reluctant because I dont give fingerprints and photo at Border. Something which is obligatory at Embassy.

Anyway, thanks for suggestions!
