ILR application doubt

Post by mailpaul32 » Wed Jul 11, 2012 11:41 pm

Hi,

Apologies if this is a repeated post but I think a couple of years ago, someone mentioned to me that on the date of your application for ILR, you should not have spent:
1. More than 180 days outside UK in the last 5 years
2. Any day outside UK in the past 90 days

I can find reference to the first clause in many places on the UKBA website and on this forum but I can't find anything on the 2nd one. Can anyone please clarify if this is the case or is it just me imagining things?

The reason I'm asking is because I am planning a trip outside UK for nearly a month just one month before my ILR application. It is not a very important trip so I can delay it if it affects my ILR application eligibility in any way.

Thanks in advance.

Regards
Paul

Hi

I can confirm that your

1) Correct Rule as per mentioned by the UKBA in the immigration rules.

2) Never heard of this rule at all what so ever.

I think you got it mixed with the rule which also says that you cant stay outside the UK in a stretch of more than 90 days continously in an year. But there's no such rule that you can't travel with in 90 days of your ILR you can travel when ever you want as long as your current visa status is valid.

Hope this will answer your question.

Please do kindly share your PEO Experience with us on the forum.

Good luck for your ILR.

Thanks a lot. It does indeed answer my question and allays the doubt that I had in my mind with regards to 90 days.

Thanks for your wishes. I'll definitely share my experience.
