Tax Return Claim & ILR

Post by oc2pus » Tue Jul 24, 2012 2:41 pm

Hi

Anyone Can tell me that If my tax code was wrong and asked HMRC to correct my tax code and return the money which I paid as a over tax.

Does this consider as benefit claim or some sort of benefit claim. If I get my over paid tax money back would it affect my ILR?

Many Thanks

A tax refund is not a Public Fund and has no bearing on your ILR application whatsoever.

Hi Casa

Much appreciate for reply. Yes, it make sense that Tax refund is not a public fund. However, I just need to sure on this. I never thought to take any benefits and dont have any intensions in future. But if I am over taxed and I kind of rip off then I have a right to get it back.

Do you refer any document or any case like this please? I do not want to spoil my five year just to claim back tax money. Much appreciate your help.

Kind Regards

With regards to your question above "Do you refer any document or any case like this please? I do not want to spoil my five year just to claim back tax money."

There won't be a document for this. I.e. getting a tax refund, because a mistake was made on your tax code is completely independent to your ILR application & has nothing to do with Public funds (as already stated). The HMRC website will be your point of reference to determine how to obtain a tax refund for what you have overpaid.
