Dear all

My question is regarding this rule.

"Your wife or husband must have spent 2 years living in the UK with you before they now qualify for Indefinite Leave to Remain."

My wife came to UK on 02-Dec-2010
Her visa expires date is: 29-Nov-2012 (as like mine).
She got her visa stamped in May 2010 Pakistan, but actually received from Gerry's Pakistan in Sept 2010.

If you calculate as per my wife stay in the UK, she is lacking 2 DAYS ONLY from completing the 2 years rule till her via expiry.

As i am due for ILR in NOV 2012 (any time after 2 Nov 2012 but before 29 Nov 2012), Can i put her name in SET(O) as dependent so that both of us passports are stamped during the IN PERSON Appoint (premium service) at the UK Border Center (Croydon).

Please confirm.

How many chances that visa officer will not fuss about 2 days lacking from exact 2 years ruling as shown above.

Could our application will be considered?

If visa officer refuses wife application, will they charge their fee for not considering her name on the application?

I had the same issue but my wife entered Uk 92 days after it was stamped and her visa was issued for 2 years 17 days. Luckily we both were Granted ILR at Solihull.

Did you apply by Post or in person?
I know that by Post it can be achiveved. I am worred, if they will grant ILR in person?

am on two years spouse visa , does it mean wen my two years end they will issue me other 3 years!

No, she has to complete 2 years only. The new rules applies to those who are granted Dependent visa for the first time after 9-Jul-2012.
