Dependant - Out of Country - Please Reply

Post by abhi_011 » Mon Jul 30, 2012 4:29 pm

Hi Forum Members,

To start with background, my Tier 1 VISA was recently extended for another 3 years till July 2015. My wife was with me on dependent VISA but left for India as we were expecting our first baby. Well recently we were blessed with beautiful baby, however my wife's VISA also expired in the mean time while she is in India.

I understand that now I have to apply for both VISA and have started filling out application and rest of documentation etc.

However I have some confusion regarding application forms, If somebody can please let me know if two application forms are required to fill their application (online) or is it has to be only one form for both of them. I could not find this information anywhere in Policy Guidance (or might have missed it). Please suggest me on no. of forms to be filled and if anybody can share the links as well that will be great.

Another doubt, if it is going to be treated as Entry Clearance or VISA Extension in my wife's case. I believe it would be Entry clearance as her VISA has already expired.

I have already maintained 900 (myself) + (2* 1800) = 4500 as maintenance funds. I believe this is the right amount in my case as I have stayed in UK for more than one year. If somebody differ on this please let me know.

Thanks,
Abhimanyu

You are not making an application so you don't need to show funds for yourself.

There are no joint applications. Each person applies individually. Applications made outside the UK are not extensions.

It is entry clearance as your wife's visa is expired.

If you stay for more than one year in UK your maintenance amount per dependent is 600, not 1800. It is not so hard to understand it from the requirements

I know it wont harm you as you are maintaining more than enough. But, you are stating as if you are maintaining the right amount which is wrong.

I believe you are right as per the table... however I didn't want to take any chances after looking at other similar threads and continuously changing rules. Many thanks for the reply.

Further doubts regarding filling Application:

There are two questions which seems to be similar, could please somebody tell me the difference and the appropriate answers:

1. Have you been granted a UK visa in the last 10 years?

Answer: Yes. As my wife stayed with me on Tier 1 dependant.

2. Have you made an application to the Home Office to remain in the UK in the last 10 years? and its associated question "Reason for application"

Doubt: What should be answer to this ? and how is this different from above question 1 ?

3. Do you have a UK National Insurance Number? and another associated question "Reason for getting a National Insurance Number"

My Wife had NI number, however she never worked in UK.
I am mentioning NI No. and giving explanation: She was looking to work in UK and NI was required for Interview purposes as one of the requirements.

Doubt: Is this explanation Correct ? Any suggestions on same.

My Wife is Unemployed currently. Could somebody please double check answers to the following Questions 4 to 8, I understand answers these questions are subject to personal status, however based on my wife's employments status, are answers to Questions 4 to 8 justified.

4. Do you receive income from any other sources‚ including friends or family?
My Answer: No

5. Do you have savings‚ properties or other income‚ for example‚ from stocks and shares?
My Answer: No

6. How much of your monthly income is used to support your family members?
My Answer: Not Applicable

7. How much do you spend each month on living costs?
My Answer: XXXXX INR

8. Please state the amount of money available and total number of dependants?
My Answer: I am currently dependant on my Husbands Income. My Husband UK Bank Account has more than XXXX GBP available. My Indian Bank Account has XXXXX INR available. Bank Statements Enclosed. Myself and my daughter are dependant on my Husband,None Dependant on me.

Please suggest. Many thanks in advance.

Cheers,
Abhimanyu
