Can I apply outside UK

Post by princess fiona » Mon Jul 30, 2012 6:17 pm

Dear,
I completed my overseas nurses programme from city university, and got a job offer from an NHS a scrub nurse which is n shortage occupation list. Therefore they provided with an unrestricted cos to apply for the visa. So I took an appointment 25 of this month in Liverpool UKBA office, when I went there, they informed me that the overseas nurses programme which I came for as a student was completed in 4 months, so you must go to home country and apply from there. I already took an appointment in home country. When I informed my sponsor they told me that they haven't tick the column that the candidate going back home country for visa application. So my question is can I apply from overseas using the cos and also is there any problem for applying the unrestricted visa from overseas. T

Thank you please reply asap as I booked tickets already.

I'm not familiar with the Overseas Nurses Program but assuming that what UKBA told you in Liverpool is correct, i.e. that you have to apply from overseas, I suggest that you contact your NHS sponsor and explain the situation.

The unrestricted CoS they assigned to you is not going to be suitable if you apply from abroad. You are likely to require a new restricted CoS but the fact that the job is on the shortage occupations list will provide priority in the monthly allocations.

Your NHS sponsor pobably sponsors many other migrant nurses and will know what to do.

Why? Just contact HR in the NHS Trust who sponsor you, they are usually helpful

I did inform them, they asked me to contact UKBA, and make sure I could apply from overseas.
Firstly, they issued me a cos without showing maintenance, somehow i convinced them to issue a second cos with maintenance. And then I applied in Liverpool. Now, if I need to change this cos, i do no what will be their reaction.

Are you sure what UKBA in Liverpool told you is correct? Do you have information about the rules that apply to the ONP that you participated in? If it was through City University talk to their student immigration advisor.

If that doesn't lead anywhere, i.e. it is confirmed that you must apply from abroad, just go back to the sponsor.

There is a rule that if i need to change to other visa from tier 4 visa, i need to complete atleast 8 months course in uk or atleast I have a uk degree. Onp is a short term course that i done to get pin no in uk to practice as a nurse. It is 3/6/9 months course, according to your ability to pass the course. I passed it in 3 months and had a course completion certificate for it either. So according to the immigratin law I am not qualified for swithching as I havent completed 8 month course. Now I have unrestricted cos. I couldnt apply here and outside uk either. What a dilemma. God pls help.
