Travelling after Tier 2 visa curtailed

Post by uniriri » Tue Jul 31, 2012 6:03 pm

Hi All,

I am currently on a Tier 2 visa. It is valid until the end of 2014 however, I am planning to hand in my notice at the end of August.

I know that once I do that, my office has to inform UKBA and they will curtail my visa to 60 days (2 months).

I would like to travel around Europe for a month or so and generally take a break before I move to back to Asia.

Can i travel in and out of the UK in the 60days period? Or would it be really troublesome? as technically I am unemployed but I would like to use the UK and my flat here as a base whilst i'm travelling around europe.

many thanks,

What is your nationality? Would you normally need to apply for a visit visa to enter the UK?

i am indonesian so yes, i would normally need to apply for a visit to enter the uk.

just remembered that in order to apply for the schengen visa, I had to show that I had more than 3 months remaining on my UK visa.

so maybe i'll have problems at both ends - entering eu and entering the uk

argh! what a pain

Once you leave during the 60 day period you won't be allowed to re-enter

thanks adytaylor

is that from experience or have you read it somewhere? not doubting you in any way - i've just been trawling through the UKBA website and so far can't find any answers.

that's a bit strict isn't? - i thought the 60days 'grace' period is sort of like the extra 3 months post estimate graduation date that UKBA add to your student visa - i.e. to use with as you please to sort out moving/finalize leaving the country/travel

ah well - will just have to quit later so that i can fit the european travel inbetween working (weekends, etc).

thanks again

From what the lawyers said about my girlfriend who is in similar situation.

The 60 days is a grace period to give you time to get things in order before you leave and nothing more by the sounds of it

Your sponsor will inform UKBA of the date when you cease to be employed by them. Your visa will then be curtailed by UKBA to 60 days from the date they make their decision to curtail, not from the date when you stopped working. They are not going to make this decision for at least 28 days after they have been informed by your employer that you are no longer employed by them.

UKBA will then write to you asking for your passport to be sent in for the curtailment will be entered.

So there are two periods:

1. after you left your employment but before your visa has been curtailed. This period iwill be at least 28 days but could be longer
2. after your visa has been curtailed.

I expect your current visa is marked MULT which means unrestricted travel in and out of the UK.

It is my opinion (I emphasize opinion) that you can travel freely in period 1 but not in period 2.

You may wish to put this question to the Immigration Enquiry Bureau (0870 606 7766) but suggest to call more than once because not all helpline staff are fully conversant with the rules.

Grounds on which leave to enter or remain which is in force is to be cancelled at port or while the holder is outside the United Kingdom

321A. The following grounds for the cancellation of a person's leave to enter or remain which is in force on his arrival in, or whilst he is outside, the United Kingdom apply;

(1) there has been such a change in the circumstances of that person's case since the leave was given, that it should be cancelled; or

This is the bit that applies to you.
